NFPA 70E for Electrical Contractors
Your crews take the industry's highest electrical risk into a different employer's hazards every day. What the contract-employer duties actually require, and why "the customer wouldn't let us shut it down" is not a defense.

01The core tension: your risk, their building
Electricians die from electricity at 2.89 per 100,000 — twenty-six times the all-worker rate — and contractors absorb most of that risk because contractors do most of the work. But the defining feature of contracting isn't the exposure; it's that every hazard belongs to someone else's facility. The panel schedule is wrong at the customer's site. The "dead" feeder is backfed at the customer's site. The incident energy label is nine years old at the customer's site. NFPA 70E's answer is the two-way street in Article 110: the host employer must share known hazards and installation information; the contract employer — you — must ensure your employees are qualified, informed, and following the program, and must report hazards you discover back to the host.
The mistake I correct most often in contractor classes: treating the host's information (or their indifference) as the ceiling of your obligation. It isn't. If the host can't produce an arc flash label, your crew doesn't inherit permission to guess — they inherit an unknown, and 70E treats unknowns conservatively: assume the hazard, verify everything, price the risk assessment into the job. The shops that thrive under this discipline sell it as professionalism. The shops that don't are betting their people on other companies' recordkeeping.
02The second tension: 1926 on Monday, 1910 on Tuesday
Contractors cross the construction/general-industry line constantly — new installation under 1926 Subpart K in the morning, service and maintenance under 1910 Subpart S after lunch. The practical differences (GFCI requirements, training framing, LOTO applicability) matter less than the discipline of knowing which regime the current task sits in. Service work — troubleshooting energized equipment in occupied facilities — is where contractors take their worst injuries, and it is squarely 70E territory: diagnostic work on energized equipment is permitted, but only inside the risk assessment, boundary, and PPE structure, and repair work beyond diagnosis needs an electrically safe work condition or a justified, permitted exception.

The contractor died; the host was cited
The Tesla Gigafactory fatality — a contract electrician electrocuted inspecting an energized UPS cabinet — is this industry's case study from the contractor side. OSHA's citations describe no PPE provided, no hazard communication, no de-energization for inspection work. Whatever the host's failures, a contract employer's own program is supposed to be the redundant layer: qualification verification, a stop-work culture, and crews trained to demand an electrically safe work condition or a justified permit before opening energized equipment.

A two-man crew is dispatched to a strip-mall tenant with "flickering lights." The panel is a 1980s loadcenter, no labels, no drawings, no host contact on site but the property manager's cell. The senior tech starts pulling covers hot to chase the neutral. Stop: no risk assessment performed, no equipment condition known, no boundaries set, an unqualified apprentice standing in the arc flash boundary holding the flashlight. This exact configuration — small commercial service work, unknown equipment, informal crew habits — produces more contractor shock injuries than any industrial site. A written service-work SOP (assess, test, isolate before repair; apprentice outside the boundary; PPE by default when condition is unknown) converts your most dangerous product line into a controlled one.

06The 2027 changes that hit contractors hardest
- The additional-person requirement — the two-man service truck just became the minimum crew for permit-level energized work, and the second person must meet emergency response training requirements and stay outside the boundary. One-tech dispatching models need restructuring.
- Host/contract employer documentation tightening — expect sophisticated hosts to demand your qualification records, and expect OSHA to ask for the information exchange in writing after any incident. Build the exchange form into your job-start paperwork.
- Hand protection for contact thermal hazards — service work in mechanical rooms and rooftop units pairs electrical exposure with hot surfaces; glove selection now has to answer for both. See the hand protection guide.
- PPE conformity assessment — when you buy arc-rated gear for the fleet, the conformity assessment method belongs in the PO. Small shops feel this as a purchasing change.
07Where contractor programs actually fail
- Qualification by tenure. "He's been doing this thirty years" is not a training record. Document task-specific qualification per 70E — it's also your best defense in multi-employer citations
- Customer pressure as justification. "The customer wouldn't let us shut it down" converts their business preference into your willful-violation exposure. The infeasibility determination is yours to make, in writing, or the work waits
- The apprentice in the boundary. Unqualified persons inside the limited approach or arc flash boundary during energized work — the most common violation I see on site visits
- PPE in the truck, not on the electrician. Ownership isn't use; spot-audit your crews like OSHA would
- No pre-job brief on "small" jobs. The two-minute documented brief is the habit that catches the backfed panel and the mislabeled disconnect
08Implementation checklist for electrical contractors
- Write (or update) your own ESP — as a contract employer you need your own program, not the host's
- Build a host-site information exchange form into job-start documents; file it both directions
- Define the service-work SOP: assess, test, isolate before repair; unknown condition = full PPE
- Restructure dispatch for the 2027 additional-person requirement on permit-level work
- Document qualification per employee, per task class, with refresher cycles and demonstrated-skills checkoffs
- Equip and audit PPE at the crew level; add conformity assessment method to purchasing specs
- Train estimators too — jobs bid without shutdown windows or standby labor are jobs that will be done unsafely
