NFPA 70E in North Carolina
North Carolina is one of the states that actually enforces its own — a full state plan covering private and public workers alike. Which makes the exceptions, and the two fatality cases below, worth knowing precisely.
01What "full state plan" actually buys you — and where it stops
North Carolina operates a full 18(e) OSHA-approved state plan through the NC Department of Labor's Occupational Safety and Health Division. Initial approval came in 1973, certification in 1976, and final 18(e) approval in December 1996 — that last date matters, because 18(e) status means federal OSHA has relinquished concurrent enforcement authority. NC OSH is not a junior partner here; it is the agency.
Coverage extends to the private sector and state and local government employees. So unlike Texas, Florida, Georgia, Pennsylvania, and Ohio, a North Carolina municipal lineman or school district electrician has real enforcement behind them.
The carve-outs almost nobody accounts for
Full coverage is not unlimited coverage, and the exceptions land hard in North Carolina specifically. Federal OSHA retains jurisdiction over:
- Maritime, shipyard, and longshoring work
- USPS contract mail operations
- Indian reservations
- Contractors on ceded federal land
- Railroad employment
- Enforcement on military bases
- The American National Red Cross
Read that military base line against a map of North Carolina. Fort Bragg/Liberty, Camp Lejeune, Seymour Johnson AFB, Cherry Point, Pope Field. An electrical contractor working inside the fence at any of them is under federal OSHA, not NC OSH — different agency, different inspectors, different penalty schedule, different appeal path. For contractors who move between base work and commercial work in the same week, that's a real program consideration, and it's the kind of thing that only surfaces after an incident if you haven't mapped it in advance.
NC-specific standards and penalty timing
NC OSH has adopted the federal standards, with a defined list of state-unique ones. Relevant here: Electric Power Generation, Transmission, and Distribution is a NC-unique general industry standard — directly applicable to Duke Energy and its contractor network. NEEDS SME REVIEW I confirmed the NC-unique standard exists but did not compare its text against 1910.269. Whether it differs substantively in training or PPE obligations needs a direct read. Construction also carries NC-unique PPE/Life-Saving Equipment and Communication Towers standards.
On penalties, North Carolina adjusts on its own schedule — July 1 annually, CPI-tied, rather than the federal January cycle. Effective July 1, 2025: serious $16,550; willful $165,514 with an $11,823 minimum; repeat $165,514; failure-to-abate $16,550 per day; and a distinctive $29,000 maximum for violations involving workers under 18.
One more NC feature worth using: the free consultation program is confidential, issues no citations or penalties, serves both private and public sector — and employers with an open Consultative Services case are not eligible for random NC OSH inspection. That is a meaningful incentive, and for a mid-sized NC employer without an electrical safety program, it's an unusually low-risk way to find out where you stand.
02Two North Carolina fatalities, and what each citation actually said
Duke Energy Carolinas — glove length killed a 25-year-old lineworker
Zachary Jones, 25, was electrocuted making secondary connections into an energized 120 V Z-bar on Wandering Creek Drive. NC OSH cited one serious violation in February 2025 at $16,131 — then the maximum for a serious violation. The finding: the employee wore 11-inch low-voltage gloves, leaving the wrist and forearm exposed. Fourteen-inch gloves, or gloves with rubber sleeves, would have prevented it.
One hundred twenty volts. Three inches of glove. This is the case I would put in front of any crew that believes voltage class determines lethality, or that PPE selection ends at "wear the gloves." Article 130's shock protection requirements include glove class and length matched to the exposure — and the exposure here included the forearm, because of how the work was reached. A young lineworker died over a specification detail that a proper PPE selection table would have caught.
Wolfspeed — technician alone in a substation, testing energized circuits
Vincent Farrell, 45, entered a substation alone and contacted energized, uninsulated copper lug connectors on a circuit breaker while testing energized circuits, becoming the path to ground. NC OSH issued two serious violations totaling $27,553.80 — $14,502 for failure to select and require appropriate hand protection, and $13,051 for employees in areas with electrical hazards without appropriate electrical protective equipment.
Three failures stacked: energized testing without a documented justification, working alone in a substation, and no shock PPE. The 2027 additional-person requirement speaks directly to the second — where an energized work permit specifies shock or arc flash PPE, a trained standby person outside the boundary is required. A lone technician in an energized substation is no longer a compliant plan, and honestly it never should have been one. Note also that this is a semiconductor company, not a utility: RTP tech and biotech facilities own substantial electrical infrastructure their safety programs sometimes treat as somebody else's problem.
One case to attribute carefully: Pike Electric, headquartered in Mount Airy, NC, lost two 19-year-old apprentices to electrocution repairing a 7,200 V distribution line after a storm on August 31, 2021 — but the incident occurred in Adger, Alabama, and federal OSHA cited it (three serious violations, $43,506). The findings are instructive for any NC utility contractor: failure to ensure removal of all jumpers from the power source, failure to train workers to recognize electrical hazards, and inadequate first-aid-trained personnel on site. It is a North Carolina company's case study; it is not an NC OSH enforcement action.
North Carolina is one of the few states where BLS publishes an electricity-exposure count at the state level — 5 deaths in 2024, 3 percent of the state total. Electricians accounted for one fatality in each of 2024 and 2023; electrical power-line installers and repairers accounted for two in 2024. NCDOL also publishes its own OSH statistical reports and an NCDOL Investigates Electrocutions fatality fact sheet, which is a useful NC-authoritative citation for internal training material.
03Licensing: contractors, not electricians
This is where North Carolina differs from what most people assume. The NC State Board of Examiners of Electrical Contractors licenses electrical contractors — firms and qualified individuals — not individual journeymen electricians. There is no statewide NC journeyman electrician license. Classifications run Limited, Intermediate, and Unlimited, plus Special Restricted categories.
Continuing education is annual, on a July 1–June 30 license period:

NFPA 70E is not a required CE topic in North Carolina. The Board's rules specify hours and delivery format, not mandated curriculum content. Board-approved 70E courses exist and count toward the eight hours — but only as an elective the licensee chooses. The consequence is blunt: a North Carolina electrical contractor can satisfy every CE hour for an entire career without ever taking an electrical safety work practices course.
Combine that with the absence of an individual journeyman license, and the picture for NC employers is clear. There is no state credential — at any level — that establishes 70E qualification for the person actually opening the panel. That determination is yours to make, document, and defend.
04Code adoption: North Carolina is frozen
North Carolina's electrical code situation is genuinely unusual and worth flagging for anyone doing design or installation work here.
The current code is the 2020 State Electrical Code (2020 NEC plus NC amendments), effective November 1, 2021 — notably excluding one- and two-family dwellings under Amendments 10.1 and 10.2.
The 2023 State Electrical Code has been adopted but its effective date is indefinitely delayed. The Building Code Council adopted it December 12, 2023; the Rules Review Commission approved it February 28, 2024; it was originally set for January 1, 2025 — and then delayed indefinitely by Session Law 2025-2 (House Bill 47), Section 5.12. North Carolina holds 36 state amendments to the 2023 NEC waiting in the wings.
The state's adoption history is irregular in general (2014 NEC effective April 2016; 2017 NEC effective June 2018; 2020 NEC effective November 2021), and North Carolina provides no transition or overlap period between electrical code editions. Administration sits with the Office of State Fire Marshal, not NCDOL. NEEDS SME REVIEW verify whether the indefinite delay has been resolved before relying on this.

06North Carolina compliance checklist
- Map which of your NC sites fall under NC OSH and which fall under federal OSHA — military bases especially
- Build 70E qualification records independently; no NC credential establishes it, and there's no individual journeyman license at all
- Rebuild your shock PPE selection to specify glove class and length per task — the Duke Energy fatality turned on three inches
- Prohibit lone energized work in substations and equivalent environments; align with the 2027 additional-person requirement now
- Public employers: you are covered — build to the standards accordingly
- Consider the free NC OSH consultation program; an open case also removes you from random inspection selection
- Confirm which code edition governs a given project — NC remains on the 2020 NEC with the 2023 edition indefinitely delayed and no transition period
- Note the July 1 penalty adjustment cycle when budgeting risk
- Steer CE hours toward electrical safety work practices — nothing requires it, so it has to be a deliberate choice
