NFPA 70E Compliance in Texas

Who enforces electrical safety in Texas, what OSHA actually cites here, what happened in real Texas electrocution cases, what your electricians' licenses require — and how the 2027 edition lands in the state's biggest industries.

01Who enforces electrical safety in Texas

Texas is a federal OSHA state for private-sector workplaces — there is no Texas state OSHA plan. Workplace electrical safety is enforced directly by federal OSHA through its area offices, applying 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices.

Federal OSHA operates nine area offices in Texas — Austin, Corpus Christi, Dallas, El Paso, Fort Worth, Houston North, Houston South, Lubbock, and San Antonio — all under Region 6 (Dallas). Two Houston offices is not an accident: the Gulf Coast petrochemical corridor generates enough inspection activity to justify them.

Three consequences of the federal-OSHA arrangement that Texas employers routinely get wrong:

  • "70E isn't law" doesn't protect you. OSHA cites the electrical work practice standards in Subpart S and uses NFPA 70E as evidence of what a reasonable employer would have done — both for specific standards and under the General Duty Clause (Section 5(a)(1)). When an incident occurs and your program doesn't hold up against 70E, that gap becomes the citation narrative.
  • Public-sector workers have no OSHA coverage at all. Because Texas has no state plan, employees of Texas cities, counties, school districts, and state agencies are not covered by OSHA. A municipal water utility electrician in Texas has no enforceable federal electrical safety standard behind them — which makes a written, 70E-based electrical safety program the only layer of protection those workers get. If you run EHS for a Texas public entity, your program isn't paperwork; it's the whole system.
  • Severe Violator Enforcement and repeat multipliers follow you across sites. Texas employers with multiple locations — common in the contractor and energy sectors — can see a citation at one site become a "repeat" at another, with penalties multiplied. One weak site program can price the whole company into six figures.

Texas consistently records more workplace fatalities than any other state — a function of workforce size, but also of industry mix: construction, oil and gas, utilities, and transportation are all overrepresented here, and three of those four carry electrical fatality rates well above the all-industry average. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) have electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).

Two more national findings that should shape a Texas program:

  • 70% of workplace electrical fatalities happen to non-electrical workers — laborers, roofers, HVAC mechanics, grounds crews, equipment operators. If your 70E training only reaches your electricians, it's missing most of the people who die from electricity. In Texas, with its enormous construction and services workforce, that gap is bigger than anywhere.
  • Hispanic and Latino workers carry a disproportionate share of electrical fatalities (0.18 per 100,000 vs. 0.10 for white non-Hispanic workers, per ESFI). Texas's construction workforce is majority Hispanic. If your training isn't delivered effectively in Spanish, it isn't delivered.

03Real Texas cases: what the citations say

Abstract risk doesn't change behavior — cases do. These are real, recent Texas incidents, drawn from OSHA enforcement records and news coverage. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.

Austin August 2024 Fatality $49,650 in OSHA penalties

Contract electrician electrocuted inspecting an energized UPS cabinet — Tesla Gigafactory

Victor Joe Gomez Sr., a contract electrician, was electrocuted on August 1, 2024 while inspecting an uninterruptible power supply (UPS) cabinet at the Austin-area Gigafactory. OSHA's investigation found employees were performing tests and inspections on electrical equipment that had not been de-energized, working near energized parts without appropriate PPE (which OSHA says was not provided), and doing so without prior hazard analysis, warning signs, or communicated safe work procedures. OSHA issued three serious violations at the statutory maximum of $16,550 each.

San Antonio July 2024 Fatality Utility

CPS Energy lineman electrocuted during power restoration

Clayton Kloesel, a 32-year-old CPS Energy lineman, was electrocuted while working to restore power on San Antonio's far west side in July 2024. Utility transmission and distribution work falls under 29 CFR 1910.269 rather than 70E's core scope — but the boundary between "utility work" and "premises wiring work" is a live jurisdictional question for every utility and utility contractor, and restoration work under time pressure is precisely where procedural shortcuts happen.

if your crews touch both sides of the service point — as most utility contractors and municipal utilities do — your program must define which rule set applies to which task, and your workers must be able to answer that question in the field. Note also: as a municipal utility, CPS Energy's workers are outside federal OSHA's jurisdiction entirely (see Section 1). The employer's own program is the only standard in play.

Fort Worth April 2026 Fatality + critical injury Contractor

One worker killed, one critically injured — bucket truck contact with power lines

Two workers were injured, one fatally, after an electrocution involving a bucket truck operating near power lines at a gas station site on East Loop 820 in south Fort Worth. Contact between elevated equipment and overhead lines is the single largest killer in workplace electrical safety — 49% of all U.S. electrical fatalities — and most of the victims are not electricians.

Article 130's approach boundaries for overhead lines, and the pre-job briefing requirement. But the deeper lesson is scope: the crew doing this work was likely never in anyone's "electrical safety training" population. The 2027 edition's emphasis on job safety planning only works if your program defines everyone who works near energized conductors as inside the program.

Southlake (DFW) March 2026 Fatality Tree care

Tree trimmer electrocuted working near power lines

Adrian Quintanilla Melgar, 46, died after contacting a power line while trimming trees in Southlake. Tree care shows up year after year in the national fatality data — grounds maintenance workers die from electricity at twelve times the all-occupation rate — and the industry sits in a regulatory gap: often small employers, often Spanish-speaking crews, rarely reached by formal electrical safety training.

If you hire tree contractors at a Texas facility, their electrical awareness training is part of your host-employer duty.

Houston Fatality $112,000 in proposed penalties Willful violations

Worker contacts live wire during wall demolition — willful citations for O.S. Interior Systems

An employee of interior contractor O.S. Interior Systems Inc. died after contacting a live wire while removing a wall at a Houston worksite on State Highway 249. OSHA cited the company for failing to protect employees from energized electrical circuits and failing to inform employees about the hazards — and classified both as willful, the category reserved for intentional disregard or plain indifference, carrying penalties several times the serious-violation maximum. Proposed penalties totaled $112,000.

Article 120's verification steps (test before touch, on every conductor, every time) exist precisely because "that circuit should be dead" is the most expensive sentence in this trade. The "willful" classification is what happens when OSHA concludes the employer knew and didn't act — the citation posture your written program and training records are designed to prevent. The pattern across all five: not one of these was an exotic failure. An inspection on equipment nobody de-energized. Restoration work under pressure. A boom too close to a line. A saw into a wall nobody tested. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments.

04TDLR licensing and what it requires

Texas licenses electricians at the state level through the Texas Department of Licensing and Regulation (TDLR) — apprentice, wireman, journeyman, master, journeyman lineman, maintenance electrician, and residential appliance installer classifications. Two facts matter for your electrical safety program:

The licensing gap is the single most misunderstood point I encounter in Texas classes. A TDLR license certifies competence in installation per the NEC. OSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock hazards, arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. A master electrician's license does not make someone a qualified person under 70E, and OSHA has cited employers who assumed it did.

05Industry by industry: where 70E does the work in Texas

Petrochemical and refining (Gulf Coast)

The Houston Ship Channel corridor and the broader Gulf Coast host one of the largest concentrations of petrochemical capacity on earth. Electrically, these sites are defined by three things: classified (hazardous) locations where an arc is an ignition source and not just a burn hazard; large motor loads and medium-voltage distribution maintained on turnaround schedules; and a contractor-dominated workforce, where the host/contract employer coordination duties of Article 110 carry most of the compliance weight. Practical example: during a turnaround, a contractor electrician racks out a 4160V breaker feeding a compressor motor. That single task involves an arc flash risk assessment, switching procedures, PPE at likely the highest incident-energy levels on site, LOTO coordination across multiple crafts, and — under the 2027 edition — a standby person if an energized permit specifying PPE is in play. Data centers (DFW, Austin, San Antonio)

Dallas–Fort Worth is one of the largest data center markets in the country, and the Austin–San Antonio corridor is growing fast. The Tesla case above is the template for what goes wrong: inspection and testing work on UPS and distribution equipment under uptime pressure, performed by contractors, on equipment nobody wanted to de-energize. Semiconductors and advanced manufacturing (Taylor, Sherman, Austin)

Multi-billion-dollar fab construction brings a specific seam: commissioning — the phase where a construction site becomes an energized facility, 1926 Subpart K hands off to 1910 Subpart S, and hundreds of contractors work around progressively energized switchgear. Energization milestones need to function as program milestones: boundaries drawn, signage posted, unqualified trades briefed, permits enforced. Wind, solar, and storage (West Texas, Panhandle)

Texas leads the nation in wind generation and utility-scale solar is expanding at pace — much of it in remote counties where the nearest coworker might be forty minutes away. The 2027 edition's dedicated solar article and the additional-person requirement change remote-site staffing math: a lone technician on an energized combiner task is no longer a compliant plan. Manufacturing (statewide)

From food processing in the Panhandle to automotive and machinery along I-35, Texas manufacturing runs on aging MCCs, lean maintenance staffing, and night shifts — the exact conditions where the 2027 additional-person rule meets its hardest test. A one-electrician night shift cannot lawfully execute an energized work permit that specifies PPE. Your options are re-engineering the task, rescheduling it, or restaffing the shift — and that decision belongs in your program now, not at 2 a.m. in front of a down production line. Public sector (cities, counties, school districts, state agencies)

As covered in Section 1: no OSHA coverage, no state plan, no enforcement backstop. Texas public entities that adopt NFPA 70E by policy give their electricians and maintenance staff the same protection private-sector workers get — and those that don't leave the gap entirely open. 06How the 2027 edition lands in Texas

Every change in the 2027 Implementation Guide applies here, but four hit Texas employers with particular force:

  • The additional-person requirement multiplies across Texas's remote wind and solar sites, lean night-shift plants, and turnaround-driven refineries. Staffing plans, not just permits, have to change.
  • Host/contract employer coordination — Texas's construction, energy, and data center economies all run on contractors. The Tesla case shows the failure mode; the 2027 edition tightens the documentation duty. If you can't produce the two-way hazard information exchange in writing, you don't have one.

07Texas employer compliance checklist

  • Confirm which OSHA area office covers each of your Texas sites, and whether any operations touch 1910.269 utility work
  • Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
  • Separate "TDLR licensed" from "70E qualified" in your training matrix — verify every worker who interacts with energized equipment has documented, task-specific qualification
  • Extend awareness-level training to non-electrical workers: operators, maintenance generalists, grounds crews, and anyone using elevated equipment near overhead lines
  • Deliver training in the language your crews actually speak — in Texas that means Spanish-language delivery capability is a program requirement, not an accommodation
  • Audit host/contract employer documentation at every site where contractors touch electrical equipment — two-way, in writing
  • Model the additional-person requirement against your actual shift rosters and remote sites before the 2027 adoption date
  • For public entities: adopt 70E by policy and fund the program — no one else is coming
