NFPA 70E in Michigan

Michigan enforces the same federal electrical requirements as everyone else — under completely different part numbers, through a different agency than the one that licenses your electricians, with no recurring continuing education behind either.

What I see in the field

01First, a correction worth making out loud

You will find claims — in trade articles, on training vendor sites, and in more than one corporate safety manual — that MIOSHA adopts NFPA 70E by reference. It does not.

I checked the standard text directly. MIOSHA General Industry Safety Standard Part 40, “Safety-Related Work Practices” (R 408.14001, filed June 1992, amended December 2018), does exactly one thing: it adopts 29 CFR 1910.331 through 1910.335 by reference, verbatim. The rules that once carried Michigan’s own unique language — R 408.14001a through R 408.14009 — were rescinded. Michigan deleted its custom provisions and went to straight federal adoption.

The words “NFPA,” “70E,” and “arc flash” appear nowhere in Part 40.

Why this matters: if your Michigan program says “we comply with 70E because MIOSHA requires it,” the premise is false and the conclusion is fragile. Your 70E obligation in Michigan works exactly the way it works everywhere else — 1910.332 requires training, 1910.333 requires safe work practices, and NFPA 70E is the recognized method for satisfying them. That is a completely sufficient basis. It just isn’t the one people cite.

02The real Michigan differentiator: everything has a different number

Michigan runs a full OSHA-approved state plan — MIOSHA, covering private sector and state and local government, initially approved October 1973 and certified January 1981. Exclusions are maritime, USPS contractors, tribal employers on reservations, and aircraft cabin crew.

What trips up multi-state employers is that MIOSHA renumbers the federal requirements into its own Part scheme. A Michigan citation reads “Part 40,” not “1910.333.” Here is the translation table your program should carry:

OSHA’s own state plan page lists “Electrical Hazards” as an area where MIOSHA differs from federal OSHA in both General Industry and Construction — but the difference is organizational, not substantive. Practical consequence: a corporate ESP written entirely in federal citations will not match what a MIOSHA inspector is reading from, and cross-referencing it after the fact is a bad time to start.

One more agency distinction Michigan employers get wrong constantly: MIOSHA sits under LEO (Department of Labor and Economic Opportunity), while LARA (Licensing and Regulatory Affairs) handles electrician licensing and the electrical code. Two different departments. Enforcement and licensure never talk to each other.

03Michigan’s continuing education requirement is not what vendors tell you

Michigan licenses electricians at the state level through LARA’s Bureau of Construction Codes under the Skilled Trades Regulation Act (2016 PA 407, Article 7), with an Electrical Administrative Board. The credential ladder is substantial:

  • Journeyman — age 20, 8,000 hours over at least 4 years supervised
  • Master — age 22, 12,000 hours over at least 6 years, plus at least 2 years holding a Michigan journeyman license
  • Exams administered by PSI, 75% passing, based on the 2023 NEC / 2023 Part 8. No exam for contractor licenses
  • No reciprocity with any state. Detroit additionally issues its own local licenses

Now the part that matters for safety. Michigan has no recurring continuing education requirement. Statute requires only a board-approved code update course within 12 months after the state construction code changes — and by its own terms, “this requirement applies only during or after those years that the state construction code is updated or changed.” LARA states it plainly: you are only required to take a code update course within one year of new code being adopted, and that does not happen every year.

Does that course cover NFPA 70E work practices? No. Its content is statutorily limited to changes in the code and basic code book usage — and the code in question is the NEC, an installation standard. A Michigan journeyman or master electrician can renew indefinitely, in full compliance, without ever receiving arc flash, PPE, energized work permit, or risk assessment training.

!Sourcing cautions

NEEDS SME REVIEW TWO SOURCING CAUTIONS: (1) The widely-marketed “15 contact hours” Michigan CE figure appears only in a proposed LARA rule draft dated December 2025 — the in-force rule, R 339.5119, states no hour figure. (2) The claim circulating online that “R 339.6031 requires 1 hr code / 1 hr safety / 1 hr act and rules” is fabricated — no such rule exists in the BCC rule set, though several CE vendors repeat it. Do not cite either without verification.

Between MIOSHA (which enforces work practices but never says “70E”) and LARA (which licenses electricians but never teaches work practices), the entire 70E training obligation in Michigan lands on the employer. No agency will do it for you and no credential implies it.

04The EV battery buildout is Michigan’s live wire

Michigan has attracted roughly $16.6 billion in EV and battery investment, and the electrical safety consequences are already showing up in the enforcement record.

MIOSHA issued seven citations: two willful lockout/tagout violations at $70,000 each and five serious at $7,000 (four later reduced to $3,500). The serious items included hazardous energy control, safeguards for personal protection, selection and use of work practices, and training for employees facing risk of electric shock — Part 40 territory, which is to say 1910.332 and 1910.333 territory. All seven citations scored gravity 10 out of 10. The company is appealing.

×The 70E connection

“Selection and use of work practices” and “training for employees facing risk of electric shock” are the two citations to sit with — those are the program itself, not a piece of missing hardware. Battery manufacturing stacks high-current DC, stored energy that lockout alone doesn’t dissipate, and thermal runaway considerations on top of conventional AC plant hazards, in facilities staffed up faster than safety culture forms. Gravity 10/10 across the board tells you how MIOSHA viewed the exposure.

05Michigan fatalities: what the record shows and what it can’t

Gutter installer in an elevated lift contacted overhead lines

A 24-year-old gutter installer working from an elevated lift contacted overhead energized lines and fell approximately 30 feet. Listed as entry 15 in MIOSHA’s 2025 fatality record.

A gutter installer. Overhead line contact remains the largest single category of workplace electrical death nationally at 49%, and the victims are overwhelmingly not electricians. Any Michigan employer whose crews operate elevated equipment — gutters, siding, signs, painting, tree work, HVAC rooftop access — owns an electrical hazard whether or not they employ a single electrician.

Read the occupation again. This is what happens when facility grounds work gets assigned to available staff rather than qualified crews. It is also a public-sector reminder — and Michigan’s state plan does cover public employees, unlike Ohio or Pennsylvania. Coverage doesn’t help if nobody defined the task as electrical work in the first place.

Two more Michigan incidents are documented but lack confirmed citation outcomes: a DTE Energy contractor lineman, Austin Chappell, 30, killed in Detroit on June 24, 2023 in contact with live overhead equipment; and a Genoa Township event on June 5, 2025 in which a concrete truck boom spreader contacted a primary overhead line, downing a conductor that critically injured two ground workers. NEEDS SME REVIEW citations UNVERIFIED for both.

!A note on Michigan data

MIOSHA’s fatality tables are anonymized by design — no employer column — and are explicitly labeled preliminary initial-report data rather than investigation findings. Because Michigan is a state plan state, federal DOL news releases do not cover Michigan private employers, so the named-employer citation record that exists for Ohio or Florida simply isn’t published the same way here. Michigan’s MIFACE program is also effectively dormant. If you need named Michigan cases, expect to file a records request.

NEEDS SME REVIEW BLS does not publish a Michigan-specific electricity-exposure count; the state release does not break it out. National comparators are 142 in 2023 and 130 in 2024. MIOSHA’s 2025 table lists 46 entries but states no official total — do not present 46 as an official figure.

06Michigan’s electrical code is current — the training isn’t

The 2023 Michigan Electrical Code, Part 8 Rules, adopts the 2023 NEC (2nd printing) with Michigan amendments — filed November 13, 2023, effective March 12, 2024, administered by LARA’s Bureau of Construction Codes. Michigan is therefore current alongside Ohio and Georgia, and ahead of Florida, North Carolina, and Chicago.

  • Automotive OEM and supplier base — the state’s industrial backbone, with legacy plant electrical infrastructure

  • Public sector — covered by MIOSHA, unlike many neighboring states
  • Steel, food processing, agriculture, Great Lakes shipping — real Michigan sectors, but no Michigan-specific electrical enforcement cases were located for them

08Michigan compliance checklist

  • Cross-reference your program to MIOSHA Part numbers (39, 40, 85, 86, 33) alongside federal citations
  • Stop asserting that MIOSHA adopts 70E — build the obligation on Part 40 / 1910.332–.333 instead, which is solid ground
  • Treat the licensing CE gap as your problem: Michigan requires no recurring electrical safety training of any licensee
  • Extend electrical awareness training to elevated-equipment trades — both 2025 fatalities above were non-electricians in lifts
  • For battery and EV plants: address DC stored energy, thermal runaway response, and commissioning-phase energization explicitly
  • Public employers: you are covered by MIOSHA — build to the standards, and define grounds and facilities tasks that involve overhead conductors as electrical work
  • Remember LEO enforces and LARA licenses; don’t expect either to reference the other
  • Model the 2027 additional-person requirement against plant night shifts and remote utility work
