Who enforces electrical safety in Arkansas, what OSHA actually cites here, what happened in real Arkansas electrocution cases, what the state's electrician licenses require — and how the 2027 edition lands in poultry plants, steel mills, distribution centers, paper mills, and the new lithium play.
01Who enforces electrical safety in Arkansas
Arkansas is a federal OSHA state for private-sector workplaces — there is no Arkansas state OSHA plan. Workplace electrical safety is enforced directly by federal OSHA, applying 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices.
The entire state is covered by a single federal OSHA area office in Little Rock, under Region 6 (Dallas) — the same region as Texas, Louisiana, Oklahoma, and New Mexico. One office for 79 counties means inspections here are overwhelmingly driven by fatalities, hospitalizations, complaints, and national emphasis programs, not routine walkthroughs. When OSHA does show up at an Arkansas site, something has usually already gone wrong — and every one of the real cases in Section 3 started exactly that way.
One wrinkle that confuses employers: the Arkansas Department of Labor and Licensing runs an occupational safety and health function — Arkansas OSH (AOSH) — that offers free OSHA consultation, SHARP and VPP support, and receives public-sector accident reports. That is real and useful, but it is not an OSHA-approved state plan, and it does not replace federal enforcement. Three consequences of the federal-OSHA arrangement that Arkansas employers routinely get wrong:
- "70E isn't law" doesn't protect you. OSHA cites the electrical work practice standards in Subpart S and uses NFPA 70E as evidence of what a reasonable employer would have done — both for specific standards and under the General Duty Clause (Section 5(a)(1)). When an incident occurs and your program doesn't hold up against 70E, that gap becomes the citation narrative. The 1910.332 and 1910.333 citations in the Arkansas cases below are 70E's training and safe-work-condition concepts wearing their federal uniform.
- Public-sector workers have no OSHA coverage. Because Arkansas has no state plan, employees of Arkansas cities, counties, school districts, and state agencies are not covered by OSHA. AOSH takes public-sector accident reports and offers consultation, but there is no enforceable electrical safety standard behind a municipal water plant electrician or a school district maintenance tech. A written, 70E-based electrical safety program is the only layer of protection those workers get — and the Pine Bluff school construction fatality below shows how close that gap sits to real projects.
- Repeat multipliers follow multi-site employers. Arkansas is home to some of the largest multi-site employers in America — poultry integrators with dozens of plants, a retail giant with distribution centers across the state, steel companies running multiple mills in one county. A citation at one site can become a "repeat" at another, with penalties multiplied. One weak site program can price the whole company into six figures.
02Arkansas by the numbers
Arkansas's raw fatality count is modest next to Texas's — but the state's industry mix concentrates electrical risk. Transportation and warehousing alone accounted for 26 of the 79 deaths in 2024, private construction had 9, and the state's dominant industries — poultry and food processing, steel, paper and timber, agriculture — all run on heavy motor loads, aging distribution equipment, and lean maintenance crews. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) have electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).
Two more national findings that should shape an Arkansas program:
- 70% of workplace electrical fatalities happen to non-electrical workers — laborers, drivers, sanitation crews, grounds crews, equipment operators. Two of the five Arkansas cases below prove the point: a truck driver and a pole-treatment crew member, neither of them an electrician. If your 70E training only reaches your electricians, it's missing most of the people who die from electricity.
- Hispanic and Latino workers carry a disproportionate share of electrical fatalities (0.18 per 100,000 vs. 0.10 for white non-Hispanic workers, per ESFI). Arkansas's poultry processing and construction workforces include large Spanish-speaking and Marshallese populations — in Springdale plants you may need training delivered effectively in three languages, not two. If your training isn't understood, it isn't delivered.
BLS publishes Arkansas fatality counts by major event category; the "exposure to harmful substances or environments" category (7 Arkansas deaths in 2024, including 3 from environmental heat) includes electricity along with heat, drugs, and chemical exposures. 03Real Arkansas cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real, recent Arkansas incidents, drawn from OSHA's inspection and investigation records and news coverage. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.
Electrician shocked identifying a circuit, falls from stepladder — Nash Electric LLC
A 45-year-old electrical technician and a coworker were identifying an electrical circuit in preparation for a light fixture upgrade at a Springdale car dealership. Standing on the cap of a 10-foot stepladder, he received an electric shock, lost his balance, and fell to the concrete floor — dying of blunt force head and neck injuries, with electrical burns to his left foot. OSHA cited his employer, Nash Electric LLC, for two serious violations — improper ladder use (1926.1053) and failure to provide appropriate PPE (1926.95) — with $13,240 in initial penalties, settled at $9,268.
"identifying a circuit" means the circuit is energized until proven otherwise — that's Article 120's electrically safe work condition and verification sequence, and 110.6's requirements for the test instruments used to do it. Article 130's shock risk assessment exists precisely for tasks like this, and it has to account for the secondary hazard that actually killed this electrician: the fall. A shock you'd survive at ground level kills you from the top of a ladder. Elevation belongs in every shock risk assessment.

Utility pole worker electrocuted when steel truss contacts overhead line — Osmose Utilities Services
A 26-year-old utility services worker and his supervisor were treating and reinforcing a utility pole in West Helena. While preparing to install a steel reinforcement truss, the worker carried the truss vertically into position — and it contacted an energized overhead power line, electrocuting him. OSHA's investigation of Osmose Utilities Services cited electrical safety training (1910.332), safeguards for personnel protection (1910.335), safe work practice (1910.333), and Subpart V first-aid availability for line work (1926.951) provisions, with $64,524 in penalties. OSHA's file notes misjudgment of clearance distance to the energized line and a lack of engineering controls for handling long conductive material.
130.9's overhead line precautions — and the job safety planning that has to precede any task where a long conductive object moves near an energized conductor. Carrying a steel truss vertically under a distribution line is exactly the scenario approach boundaries exist for, and the pre-job briefing is where somebody says "carry it flat." Pole restoration crews work in utility space but are usually contractor employees doing non-utility tasks — which is why their training (110.4) and their host utility's information exchange (110.5) both have to reach them.

24-year-old electrician killed wiring a 480V main distribution panel — Julian Contracting
A 24-year-old electrician and his supervisor had pulled 3/0 wire through conduit to connect a 480-volt, 3,000-amp main distribution panel to a machine at an industrial park site in Heber Springs. The employee received an electric shock that caused unconsciousness and a burn to his right arm; he died of cardiac arrest. OSHA found he was working without insulated tools and without protective equipment, and cited Julian Contracting, Inc. for two serious violations — PPE (1926.95) and protection from electrical hazards (1926.416) — with $22,584 in initial penalties, settled at $11,292.
terminating conductors at an energized 3,000-amp panel is the textbook Article 120 moment: establish an electrically safe work condition, or justify energized work under 130.2, document it on a 130.3 permit, and select PPE under 130.7 for what a 480V/3000A bus can deliver — likely the highest incident energy in the building. None of that happened. And note the age: a 24-year-old with a supervisor present. Supervision is not qualification, and presence is not protection. The 2027 additional-person provisions only save lives if that person is trained and positioned to act.

Truck driver electrocuted after tarp pole contacts three-phase line — H. J. Saeler, Inc.
At 7:20 p.m. in a Waldo truck yard, a 43-year-old truck driver was operating a pole tarp on a semi-trailer when the tarp pole contacted a three-phase overhead power line — energizing the truck and starting fires at its front and rear. The driver attempted to extinguish the fires, made contact with the energized vehicle, and was electrocuted. OSHA cited H. J. Saeler, Inc. for serious violations including electrical safety training for unqualified employees (1910.332) and safe work practices near overhead lines (1910.333, 1910.335), with $18,750 in initial penalties, settled at $9,375.
this is the 70% statistic with a face: a driver, not an electrician, killed by a hazard nobody trained him to see. OSHA's 1910.332 citation is the federal version of 110.4's training requirement — awareness-level training for unqualified workers whose jobs put them near energized conductors. A worker who understands that a vehicle in contact with a line is energized, and that you move away rather than fight the fire, survives this incident. Overhead lines over truck yards, grain operations, and loading areas belong in your hazard survey (130.9) even if no "electrical work" ever happens there.

22-year-old electrician fatally shocked at Pine Bluff High School construction site
Just before 7 a.m. on March 11, 2026, a 22-year-old electrician — an apprentice working toward his journeyman license — suffered a fatal electric shock at the construction site of the new Pine Bluff High School. He worked for a subcontractor under the project's general contractor, East Harding Construction. OSHA was notified immediately and opened an investigation. whatever the investigation concludes, three program questions decide cases like this one: Was the circuit verified de-energized under Article 120 before work began? Was an apprentice being supervised by a qualified person as 110.4's training framework assumes? And did the general contractor and electrical subcontractor actually execute the two-way hazard information exchange 110.5 requires — the duty the 2027 edition tightens further? Note also where this happened: a public school district project. The workers were private-sector and OSHA-covered, but the owner is a public entity with no OSHA obligations of its own — one more reason contract documents have to carry the safety requirements.

The pattern across all five: not one of these was an exotic failure. A circuit check from the top of a ladder. A steel truss carried the wrong way. A panel termination nobody de-energized. A tarp pole under a line nobody surveyed. A school jobsite on an ordinary Wednesday morning. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments.
04Arkansas licensing and what it requires
Arkansas licenses electricians at the state level through the Board of Electrical Examiners, housed in the Arkansas Department of Labor and Licensing — the same department that runs the AOSH consultation program. The board issues master and journeyman licenses, residential classifications, and specialty licenses, and registers apprentices working under licensed supervision. The licensing gap is the single most misunderstood point I encounter in class. An Arkansas journeyman or master license certifies competence in installation per the NEC. OSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock hazards, arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. A master electrician's license does not make someone a qualified person under 70E, and OSHA has cited employers who assumed it did. The Heber Springs case — an electrician at a 480V panel with no insulated tools and no PPE — is what that assumption looks like in an investigation file.
05Industry by industry: where 70E does the work in Arkansas
Poultry and food processing (Springdale, statewide)
Arkansas is the heart of American poultry — Tyson Foods is headquartered in Springdale, and integrators run processing plants, hatcheries, and feed mills across the state. Electrically, poultry processing is defined by wet everything: washdown environments where water, conductive floors, and energized equipment share space every single day, making GFCI protection, equipment bonding, and enclosure integrity life-safety systems rather than code details. The riskiest window is the overnight sanitation shift — often contractor crews, often working around energized motor control centers with water under pressure, at exactly the staffing levels where the 2027 additional-person requirement bites hardest. Add ammonia refrigeration engine rooms, where an arc is an ignition source, and a multilingual workforce that training has to actually reach. Full treatment: NFPA 70E for Manufacturing.
Retail, distribution, and data centers (Bentonville, Northwest Arkansas)
The Walmart headquarters ecosystem makes Northwest Arkansas one of the densest corporate-facilities markets in the country — and the state runs on distribution: dozens of large DCs, automated conveyor and sortation systems, lift-truck battery charging rooms, and facility electrical rooms maintained under relentless uptime pressure. That's the same failure template as any critical facility: testing and troubleshooting on equipment nobody wants to de-energize, performed by contractors, at night. Arkansas is also drawing serious data center interest — cheap land, fiber routes, and available generation make it a candidate market — and the operators arriving here bring UPS systems, paralleling switchgear, and battery rooms governed by Article 360. Steel on the Mississippi (Blytheville, Osceola — Mississippi County)
Mississippi County has quietly become one of the largest steel-producing counties in America: Nucor and Nucor-Yamato in the Blytheville–Armorel corridor, and U.S. Steel's Big River Steel works in Osceola, including some of the newest flat-roll capacity in the hemisphere. Electric arc furnace mills are, electrically, utility-scale industrial hybrids — medium-voltage distribution everywhere, enormous transformer and furnace loads, and maintenance outages executed by armies of contractors on compressed schedules. Racking medium-voltage breakers, testing protective relays, and re-energizing after an outage are the highest-incident-energy tasks in Arkansas industry, and the host/contract employer coordination duties of 110.5 carry most of the compliance weight during every outage. New mills also mean commissioning — the phase where 1926 Subpart K hands off to 1910 Subpart S and progressively energized switchgear surrounds hundreds of construction workers. Paper, timber, and agriculture (south Arkansas, the Delta)
South Arkansas runs on wood — pulp and paper mills, sawmills, and engineered wood plants — and the Delta runs on row crops, grain elevators, and irrigation. Both share an electrical profile: aging infrastructure, remote sites, small maintenance crews, and overhead distribution lines crossing working areas. Two of the five cases above happened in exactly this corridor — a pole-restoration worker in West Helena and a truck driver under a three-phase line in Waldo. Grain augers, irrigation pipe, and truck tarps near overhead lines kill more workers than switchgear does in rural Arkansas, which means the program that saves lives here is mostly awareness-level: hazard surveys of every yard and field access, marked clearances, and training for people who will never open a panel.
Lithium, bromine, and the Smackover play (El Dorado, Magnolia)
South Arkansas has produced bromine from Smackover formation brine for decades — Albemarle and LANXESS operate major plants around Magnolia and El Dorado — and the same brine is now the center of one of the country's most-watched lithium plays, with ExxonMobil, Standard Lithium, and others advancing direct-lithium-extraction projects. For electrical safety, these are chemical process facilities: classified locations where arcs are ignition sources, large pump and compressor loads, and — as lithium projects build out — new substations, rectifier systems, and process electrification going in fast, with heavy contractor presence during construction and commissioning. Employers coming to the play from oil and gas will find the electrical program expectations familiar; employers new to process industries should not learn them by citation. Public sector (cities, counties, school districts, state agencies)
As covered in Section 1: no OSHA coverage and no state plan. AOSH accepts public-sector accident reports and offers consultation, but no enforcement stands behind an Arkansas municipal utility worker, county road crew, or school maintenance department. Public entities that adopt NFPA 70E by policy give their electricians and maintenance staff the same protection private-sector workers get — and those that don't leave the gap entirely open. 06How the 2027 edition lands in Arkansas
Every change in the 2027 Implementation Guide applies here, but four hit Arkansas employers with particular force:
- The additional-person requirement lands on overnight sanitation shifts in poultry plants, one-electrician paper mills and sawmills, and rural co-op territory where the nearest coworker is a county away. If an energized work permit specifies PPE, a lone worker is no longer a compliant plan — staffing, not just paperwork, has to change.
- Host/contract employer coordination — steel mill outages, DC maintenance, plant sanitation, and school construction all run on contractors in Arkansas. The Pine Bluff case shows the failure mode under investigation right now; the 2027 edition tightens the documentation duty. 07Arkansas employer compliance checklist
- Know your enforcement reality: one federal OSHA area office (Little Rock, Region 6) — and confirm whether any of your operations touch 1910.269 utility work
- Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
- Separate "state licensed" from "70E qualified" in your training matrix — verify every worker who interacts with energized equipment has documented, task-specific qualification, and that apprentices are actually supervised by qualified persons
- Extend awareness-level training to non-electrical workers: drivers, sanitation crews, grain handlers, grounds crews, and anyone operating elevated equipment or long conductive material near overhead lines
- Deliver training in the languages your crews actually speak — in Arkansas poultry and construction that can mean Spanish and Marshallese as well as English
- Survey every yard, dock, and field access for overhead line exposure — the Waldo and West Helena cases both happened under lines nobody had flagged
- Audit host/contract employer documentation at every site where contractors touch electrical equipment — two-way, in writing
- Model the additional-person requirement against your actual shift rosters — especially overnight sanitation and one-electrician operations — before the 2027 adoption date
- For public entities: adopt 70E by policy and fund the program — AOSH consultation can help, but no one else is coming
