01Who enforces electrical safety in Kansas
Kansas is a federal OSHA state for private-sector workplaces — there is no Kansas state OSHA plan. Workplace electrical safety is enforced directly by federal OSHA, applying 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices.
The entire state is covered by a single federal OSHA area office in Wichita, under Region 7 (Kansas City). One office for 82,000 square miles does not mean low scrutiny: Region 7 runs targeted emphasis programs that land squarely on Kansas industry — including a grain handling safety emphasis program expanded in 2024 to address continued deaths and injuries across Kansas, Missouri, and Nebraska. If you operate elevators, feed mills, or ag processing in Kansas, you are on a list.
Three consequences of the Kansas arrangement that employers routinely get wrong:
- "70E isn't law" doesn't protect you. OSHA cites the electrical work practice standards in Subpart S and uses NFPA 70E as evidence of what a reasonable employer would have done — both for specific standards and under the General Duty Clause (Section 5(a)(1)). When an incident occurs and your program doesn't hold up against 70E, that gap becomes the citation narrative.
- Public-sector workers get evaluations, not enforcement. Because Kansas has no state plan, employees of Kansas cities, counties, school districts, and state agencies are not covered by OSHA. What Kansas does have — unlike Texas — is the Kansas Department of Labor's Industrial Safety and Health Division, which under K.S.A. 44-636 conducts safety and health evaluations of public entities every three to five years, responds to complaints, and requires public employers to report workplace fatalities. That's consultation, not enforcement: no citations, no penalties, no abatement orders. A written, 70E-based electrical safety program remains the only real layer of protection a municipal lineman or school district maintenance electrician has. The Wellington case in Section 3 is exactly this scenario.
- Repeat multipliers follow you across sites. Kansas employers with multiple locations — co-op elevator networks, packing companies, contractors working the whole I-70 and I-35 corridors — can see a citation at one site become a "repeat" at another, with penalties multiplied. One weak site program can price the whole company into six figures.
02Kansas by the numbers
Kansas's fatality counts are modest by Texas standards, but the industry mix is unforgiving: agriculture, transportation, and construction led the 2023 numbers, and two of those three put workers around energized conductors constantly — grain elevator motor rooms, irrigation systems, overhead lines along every section road. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) have electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).
Three more findings that should shape a Kansas program:
- 70% of workplace electrical fatalities happen to non-electrical workers — farmhands, HVAC mechanics, sanitation crews, tree trimmers, equipment operators. Every one of the five Kansas cases below except one involved someone who wasn't working as an electrician at a fixed facility. If your 70E training only reaches your electricians, it's missing most of the people who die from electricity.
- Kansas's fatality demographics skew old. Nearly half of the state's 2023 workplace deaths were workers 55 or older. Thirty years of experience is exactly what normalizes racking out a breaker without gloves "because I've done it a thousand times." Tenure is not qualification, and your refresher training cadence has to fight that.
- Hispanic and Latino workers carry a disproportionate share of electrical fatalities nationally (0.18 per 100,000 vs. 0.10 for white non-Hispanic workers, per ESFI). Southwest Kansas's packing plant workforce is heavily immigrant, with dozens of first languages in a single plant. If your training isn't delivered in the languages your crews actually speak, it isn't delivered.
BLS publishes Kansas fatality counts by major event category; the "exposure to harmful substances or environments" category (5 Kansas deaths in 2023) includes electricity along with heat, drugs, and chemical exposures. Kansas-specific electrocution counts are compiled from CFOI microdata. 03Real Kansas cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real Kansas incidents, drawn from OSHA enforcement records and news coverage. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.
Solar installer electrocuted hoisting a metal rail into overhead lines — Power Factor LLC
An employee of solar contractor Power Factor LLC was fatally electrocuted at a Fort Riley jobsite while hoisting a metal rail that contacted energized overhead power lines during a solar panel installation. OSHA issued four serious violations totaling $39,836 — for permitting workers in close proximity to energized circuits without de-energizing, grounding, or insulating them, and for failing to maintain a safety program with regular jobsite inspections and hazard training. OSHA's Wichita area director said it plainly: this tragedy could have been prevented if the employer had complied with the electrical standards. 130.9's overhead line precautions and Article 130's approach boundaries exist precisely for conductive objects — rails, ladders, pipe — moving near lines. And note the industry: solar. The 2027 edition gives PV work its own article (380) because incidents like this one keep proving that renewable buildout crews are electrical workers whether or not anyone calls them that. Training and jobsite hazard assessment weren't extras here; they were the two things OSHA cited.

HVAC worker electrocuted on the job — one of four Midwest electrical deaths in five months
A 41-year-old worker performing heating and air conditioning work in Wichita was electrocuted on July 13, 2021. The death was serious enough — alongside three others in Kansas and Missouri that year — that OSHA's Region 7 office issued an unusual public plea urging Midwest employers to emphasize electrical safety, noting that these deaths "could have been prevented" with proper de-energization, verification, and training.
HVAC mechanics live inside the 70% statistic — non-electrical workers who die from electricity. They open disconnects, work in energized air handlers, and troubleshoot 480V condenser units, usually with no arc flash or shock training at all. Article 110.4's training requirement and Article 120's verification steps (test before touch, every conductor, every time) apply to the task, not the job title. If your mechanical crews touch energized equipment, they're in your 70E program's scope — or they're unprotected.

Electrical contractor electrocuted climbing a pole
A month before the Wichita death, a 35-year-old electrical contractor was electrocuted on June 8, 2021 while climbing a pole in Lawrence — cited in the same OSHA Region 7 release. Pole work sits at the jurisdictional seam between NFPA 70E's core scope and 29 CFR 1910.269 utility work, and contractors cross that seam constantly: premises service work one day, line work the next.
if your crews touch both sides of the service point, your program must define which rule set applies to which task — 130.9's overhead line requirements and minimum approach distances on one side, 1910.269's cover-up and gloving rules on the other — and your workers must be able to answer that question in the field, before their hands leave the ground. An experienced contractor dying on a pole is almost never a knowledge gap; it's a verification step skipped under schedule pressure.

Apprentice lineman electrocuted at a city power plant substation
An apprentice lineman with the City of Wellington's electric distribution department — on the job since January of that year — was fatally electrocuted on September 4, 2024 after contacting energized equipment while working on wildlife guarding equipment at the city's power plant substation. Two other linemen at the site were uninjured.
two failures worth studying. First: an apprentice is, by definition, not yet a qualified person — Article 110.4 puts unqualified and in-training workers under the direct supervision structure of the program, and installing wildlife guards on or near energized substation equipment is exactly the task where that structure earns its keep. Second: as a municipal utility, Wellington's workers sit outside federal OSHA's jurisdiction entirely (see Section 1) — KDOL can evaluate, but no agency could have cited or fined here. The employer's own program was the only standard in play, which is precisely why Kansas public entities need to adopt one.

Tree trimmer electrocuted after bucket truck contact with a 7,200-volt line
A 39-year-old tree trimmer working from a mobile bucket truck contacted a 7,200-volt power line while trimming trees for a homeowner near Maple and Meridian in west Wichita on May 11, 2026. He was found unresponsive in the aerial bucket with a nearby tree on fire, and died at the hospital. The contact knocked out power to more than 1,000 customers. Grounds maintenance workers die from electricity at roughly twelve times the all-occupation rate, and the industry sits in a regulatory gap: small employers, informal crews, rarely reached by any formal electrical safety training.
minimum approach distances for unqualified persons — Article 130's limited approach boundary for overhead conductors — and 130.9's precautions for work near overhead lines. Overhead contact is the single largest killer in workplace electrical safety (49% of all U.S. electrical fatalities), and elevated equipment near distribution lines is its signature mechanism. The pattern across all five: not one of these was an exotic failure. A rail hoisted under a line. A condenser unit nobody de-energized. A pole climbed on an ordinary Tuesday. Wildlife guards on energized gear. A bucket too close to a 7,200-volt conductor. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments.
04Licensing in Kansas: there is no state license
Kansas has no statewide electrician license and no statewide electrical contractor license. Licensing — where it exists at all — happens at the city and county level, and the requirements change every time your truck crosses a jurisdiction line. Three facts matter for your electrical safety program:

The no-license patchwork makes the employer's qualified-person determination more load-bearing in Kansas than almost anywhere. In a state-licensed jurisdiction, a license at least proves baseline installation competence. In rural Kansas, there may be no third-party credential of any kind between a new hire and a 480V motor control center at a country elevator. OSHA's "qualified person" concept — and 70E's — requires demonstrated, documented training on the specific hazards of the specific tasks: shock, arc flash, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. 05Industry by industry: where 70E does the work in Kansas
Aviation manufacturing (Wichita)
Wichita is the Air Capital: Spirit AeroSystems' massive fuselage works, Textron Aviation's Cessna and Beechcraft plants, and a deep tier of machine shops and suppliers. Electrically, these are classic legacy-manufacturing environments — million-square-foot plants with decades-old MCCs and substations, autoclaves and heavy process loads, maintenance crews working nights and weekends around production schedules, and contractor trades layered on top for tooling and facility work. Aging switchgear with deferred maintenance is an arc flash incident-energy problem (Chapter 2 of 70E exists because protective devices that aren't maintained don't clear faults as designed), and the host/contract employer duties of Article 110 carry real weight on a floor where the badge colors change by the week. Meatpacking and food processing (Dodge City, Garden City, Liberal)
Southwest Kansas slaughters and processes a huge share of the nation's beef. Electrically, packing plants are defined by water: high-pressure washdown every night, wet floors around energized equipment, and corrosion working on every enclosure and conduit seal in the plant. The highest-risk population is often the night sanitation crew — frequently a contractor, frequently new workers, frequently multilingual — spraying water around motors, panels, and cords at 2 a.m. GFCI protection, enclosure integrity, and awareness-level training for sanitation workers are 70E program elements here, not electrical-shop trivia. And the language finding from Section 2 applies with full force: training that isn't delivered in Spanish, and often several other languages, isn't delivered.
Grain elevators and ag processing (statewide)
Kansas's skyline is the country elevator, and its co-op networks run hundreds of them plus feed mills, fertilizer plants, and processing facilities. Grain handling gives you two overlapping electrical problems: classified (hazardous) locations, where grain dust makes an arc an ignition source and not just a burn hazard — Kansas knows how that ends — and lone workers, because a country elevator may be staffed by one or two people who do everything, including resetting the bucket elevator motor starter. OSHA's regional grain handling emphasis program means inspection attention is already pointed at these sites. Wind energy and transmission (central and western Kansas)
Kansas generates a larger share of its electricity from wind than nearly any other state, with thousands of turbines strung across the central and western counties and major new transmission projects approved to move that power. Wind technicians work alone or in pairs, up-tower and in pad-mount equipment, often an hour from the nearest coworker — and the 2027 edition's additional-person requirement changes that staffing math: a lone tech on an energized task specifying PPE is no longer a compliant plan. Utility-scale solar and battery storage projects are following the same corridors, adding DC and stored-energy hazards that lockout alone doesn't control (Articles 310, 360, and the new 380). Oil and gas (Hugoton field, El Dorado and McPherson refining)
Southwest Kansas sits atop the Hugoton gas field — one of the largest natural gas fields in North America, now in long decline but still worked by pumpers, compressor techs, and well-service crews across enormous distances. Add the refining and midstream assets around El Dorado and McPherson and you get the familiar oil-and-gas electrical profile: classified locations, remote unstaffed facilities, aging field electrical gear, and contractor crews under host-employer coordination duties. EV batteries and the De Soto buildout (Kansas City metro)
Panasonic's multi-billion-dollar battery plant in De Soto — one of the largest economic development projects in state history, now expanding toward AI data center battery production — brings Kansas a hazard profile the state's workforce hasn't seen at scale: large-format lithium-ion cells and high-capacity DC systems that cannot be de-energized in any conventional sense, plus the commissioning seam where 1926 Subpart K construction work hands off to 1910 Subpart S general industry around progressively energized equipment. Public sector (cities, counties, school districts, state agencies)
As covered in Section 1: no OSHA coverage, but a state evaluation program. KDOL's Industrial Safety and Health Division will evaluate a Kansas public entity every three to five years and respond to complaints — genuinely useful, and more than Texas public workers get — but it issues no citations and imposes no penalties. The Wellington case shows what's actually protecting a municipal utility crew: the employer's own program, or nothing. Kansas cities, counties, and districts that adopt NFPA 70E by policy give their electricians and maintenance staff the same protection private-sector workers get. Those that don't leave the gap entirely open.

06How the 2027 edition lands in Kansas
Every change in the 2027 Implementation Guide applies here, but four hit Kansas employers with particular force:
- The additional-person requirement collides head-on with how rural Kansas actually staffs: one-person country elevators, lone wind techs, solo pumpers in the Hugoton, one-electrician night shifts in packing plants. Staffing plans, routes, and on-call structures — not just permits — have to change.
- Host/contract employer coordination — the De Soto construction ramp, aviation plant contractor trades, and contract sanitation crews in packing houses all run on the two-way hazard information exchange the 2027 edition tightens. 07Kansas employer compliance checklist
- Confirm your relationship to the Wichita OSHA area office, and whether any operations fall under the Region 7 grain handling emphasis program or touch 1910.269 utility work
- Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
- Treat qualification as an employer function, not a license check — in most of Kansas there is no license to check. Verify every worker who interacts with energized equipment has documented, task-specific 70E qualification
- Extend awareness-level training to non-electrical workers: HVAC mechanics, sanitation crews, elevator operators, grounds crews, and anyone using elevated equipment near overhead lines
- Deliver training in the languages your crews actually speak — in southwest Kansas packing towns that's a program requirement, not an accommodation
- Audit host/contract employer documentation at every site where contractors touch electrical equipment — two-way, in writing
- Model the additional-person requirement against your actual rosters: lone elevator staff, remote wind and gas sites, and night shifts, before the 2027 adoption date
- For public entities: KDOL's evaluation program is not an electrical safety program — adopt 70E by policy and fund it
