NFPA 70E Compliance in Montana

Who enforces electrical safety in Montana, how the state's public-employer program differs from federal OSHA, what happened in real Montana shock and electrocution cases, what the State Electrical Board's licenses do and don't cover — and how the 2027 edition lands in a state built on mines, refineries, grain, hydro, and very long distances between coworkers.

01Who enforces electrical safety in Montana

Montana is a federal OSHA state for private-sector workplaces — Montana does not have an OSHA-approved state plan. Private-sector electrical safety is enforced directly by federal OSHA, applying 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe electrical work practices.

Federal OSHA covers all 56 Montana counties from a single area office in Billings, under Region 8 (Denver). One office for 147,000 square miles has a practical consequence: inspections here are overwhelmingly complaint-, referral-, and incident-driven. Employers in the Hi-Line, the Flathead, or the Bakken edge sometimes read that as low enforcement risk. It isn't — it means the inspection that does arrive almost always follows a hospitalization or a fatality, when the citation narrative is already written.

Montana's public sector is where this state differs from other federal-OSHA states — and where employers most often get the details wrong:

  • Public employees are covered by state law, not by OSHA. Montana is not on OSHA's list of approved state plans — full or public-employee-only. Instead, the Montana Safety Culture Act and the state's occupational safety and health statutes (MCA Title 50, chapter 71) require public employers — cities, counties, school districts, and state agencies — to maintain safety programs, and give the Montana Department of Labor & Industry's Safety & Health Bureau authority to inspect them. The bureau conducts roughly 200–250 public-employer inspections a year. That is real coverage — but it is a state-law program with its own rules and penalty structure, not federal OSHA with a different letterhead.   • Jurisdiction in Montana is a patchwork, and your program has to name which rulebook applies to which task. Mines — Stillwater, Montana Resources in Butte, coal in the Powder River country — fall under MSHA, not OSHA. Railroad operations sit largely with the FRA. Utility transmission and distribution work runs under 1910.269. Public entities answer to DLI. Everything else private is federal OSHA. A contractor whose crews touch a mine site, a substation, a school, and a commercial building in the same month crosses four enforcement regimes — and 70E is the one framework that travels with the worker across all of them.
  • "70E isn't law" doesn't protect you. OSHA cites the Subpart S work practice standards and uses NFPA 70E as evidence of what a reasonable employer would have done — both for specific standards and under the General Duty Clause. When an incident occurs and your program doesn't hold up against 70E, that gap becomes the citation narrative. MSHA investigators apply the same logic on mine property: lockout without verification is the finding that keeps appearing in Montana fatality reports.

Montana's headline numbers are small — 31 deaths in 2024 — but the rate is what matters: at 5.8 per 100,000 full-time workers, Montanans die on the job at well above the national pace, and agriculture alone accounted for nearly half the state's 2024 fatalities. The state's industry mix explains it: agriculture, mining, utilities, construction, and transportation are all overrepresented here, and nationally the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) carry electrical fatality rates roughly seven times the all-occupation rate of 0.11. Electricians as an occupation sit at 2.89 per 100,000 — twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).

Two national findings that should shape a Montana program:

  • 70% of workplace electrical fatalities happen to non-electrical workers — farmhands, ranch crews, roofers, equipment operators, grounds crews. In a state where grain augers, irrigation pipe, ladders, and boom equipment routinely move under rural distribution lines, the people most likely to die from electricity have never sat through an electrical safety class. If your 70E training only reaches electricians, it's missing most of the exposure.
  • Overhead line contact is the single largest killer — 49% of all U.S. workplace electrical fatalities. Montana's version of this statistic looks like an aluminum ladder against a service drop, a crane boom near a transmission line at a dam, or a moved auger on a July afternoon. 03Real Montana cases: what the investigations say

Abstract risk doesn't change behavior — cases do. These are real Montana incidents, drawn from federal investigation records and Montana news coverage. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.

Columbus (Stillwater County) July 2025 Fatality MSHA — 3 enforcement actions

Mine electrician locked out the wrong switch — 7,600-volt contact underground at the Stillwater mine

On July 26, 2025, a 50-year-old electrician died underground at Sibanye-Stillwater's palladium mine near Columbus. Preparing for transformer maintenance, he placed his lockout device on the switch his supervisor had indicated — but that switch controlled a different transformer. The switch was unlabeled, and investigators found which units it fed "could not be readily determined by its location." When he entered the transformer enclosure to clean it, he contacted 7,600 volts. MSHA's report cited failure to ensure power was de-energized, failure to label principal power switches, and inadequate training on a new power shutdown procedure, and issued three enforcement actions. He had five and a half years at the mine and roughly two decades of prior electrical experience — it was the fourth fatality at the site in four years, and the mine halted operations after the incident.

mines answer to MSHA, not OSHA — but the failure here is precisely what Article 120's verification steps exist to catch. A lock on a disconnect is not an electrically safe work condition; 120.6's sequence requires verifying you've opened the right source and testing for absence of voltage on the conductors you're about to touch, every time. Twenty-plus years of experience did not substitute for that test. Unlabeled switchgear is a program failure, not a worker failure — and Article 110's training duties cover new procedures, not just new hires.

Crane contacts a 100,000-volt transmission line — two contractors' workers burned

On July 10, 2020, crews were setting concrete block forms with a Link-Belt TCC-750 crane during an alteration project at a Montana power plant when the crane made contact with an energized 100,000-volt overhead transmission line. Two workers — one from IMCO General Construction, one from Associated Underwater Services — were hospitalized with electrical burns to the hand and arm. OSHA's Billings office opened parallel investigations of both employers; its summaries state the crews were working within the minimum approach distance of the energized lines.

this is 130.9 — work near overhead lines, and the approach distances that apply to equipment, not just people — plus the job safety planning that should have flagged an energized 100 kV circuit above a crane pick before anyone rigged a load. And because two employers' workers were burned by one boom, it's also Article 110's host/contract employer coordination: on a multi-employer generation site, "whose hazard analysis covers the crane?" needs a written answer before mobilization, not after the burn unit.

Montana residential jobsite December 2020 Fatality Non-electrical worker

Gutter installer electrocuted when an aluminum ladder contacted an overhead power line

On December 21, 2020, a 31-year-old employee of Quality Seamless Gutters of Montana, Inc. was installing snow stops on a residential roof when his 18-foot extended aluminum ladder contacted overhead power lines. He was electrocuted; a coworker performed CPR until emergency services arrived, and he was pronounced dead at the hospital. OSHA's Billings office investigated (inspection 1508021.015). He was a sheet-metal and roof-repair worker — not an electrician, and almost certainly never inside anyone's "electrical safety training" population.

Article 130's approach boundaries for overhead conductors, applied to unqualified persons — and the reason 70E awareness training can't stop at the electrician roster. A conductive ladder within reach of a service drop is the textbook version of the contact that kills 49% of U.S. electrical fatality victims. If your crews carry ladders, gutter coil, irrigation pipe, or grain probes, the location of the nearest overhead line belongs in every job briefing, all four seasons — this one happened four days before Christmas.

Conrad (Pondera County) August 2024 Fatality Rural electric cooperative

Co-op lineman killed when a pole toppled during single-phase line work

On August 9, 2024, a 28-year-old Sun River Electric Cooperative lineman was killed south of Conrad when a utility pole toppled while he was performing maintenance on a single-phase power line. He had joined the co-op less than a month earlier, on July 15. Linemen from nine Montana electric cooperatives lined the road with bucket trucks for his memorial procession — a measure of how small and tight the state's line trade is. The co-op announced an internal investigation; news reports did not attribute the death to electrical contact.

line work runs under 1910.269 rather than 70E's core scope — but this case is on the page because it's the Montana staffing reality in one frame: a new hire, a single-phase line, and a work site an hour from the next crew. Pole-integrity assessment before loading a pole, new-employee qualification and direct supervision, and the job briefing are the 269-side analogs of 70E's qualified-person and job safety planning requirements. Co-ops and their contractors whose crews also touch premises wiring — shop panels, irrigation services, meter bases — need the 70E side of the program to be just as explicit about who's qualified, for what, with whom.

The pattern across all four: not one of these was an exotic failure. A lock on the wrong, unlabeled switch. A crane pick under a line everyone could see. A ladder against a service drop. A pole that gave way under a new hire. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments, and in Montana most of them happen a long way from help.

04State Electrical Board licensing and what it requires

Montana licenses electricians at the state level through the Montana State Electrical Board, housed in the Department of Labor & Industry — apprentice registration plus residential, journeyman, and master electrician licenses, alongside electrical contractor licensing. Two facts matter for your electrical safety program:

The licensing gap is the single most misunderstood point I encounter in Montana classes. A State Electrical Board license certifies competence in installation per the NEC. OSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock hazards, arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. A master electrician's license does not make someone a qualified person under 70E — the Stillwater electrician had two decades of experience and a lock in his hand, and neither verified the switch.

05Industry by industry: where 70E does the work in Montana

Mining and mineral processing (Stillwater, Butte, Colstrip country)

From the Butte copper legacy at Montana Resources to Sibanye-Stillwater's palladium operations at Nye and East Boulder, Montana mining runs medium-voltage distribution underground and at concentrators — 4160 V and above, portable power, trailing cables, and substations in wet, confined, remote conditions. Mine property belongs to MSHA, and 30 CFR Part 57's electrical rules apply — but the Stillwater case above shows the practice gap is identical to 70E's: verification, labeling, and training on changed procedures. Mining contractors are the seam to watch: the same electrician who works under MSHA rules Monday may be on an OSHA-covered mill or shop site Tuesday, and your program has to make both rulebooks produce the same behavior — test before touch. Oil, gas, and refining (the Bakken edge, Billings and Laurel)

Eastern Montana rides the western edge of the Bakken — well pads, gathering systems, and compression scattered across Richland and Roosevelt counties — while Billings and Laurel host the state's refining cluster. Electrically, that means classified locations where an arc is an ignition source, motor control on remote pads serviced by lone technicians, and turnaround-driven refinery maintenance where contractors carry most of the exposure and Article 110's host/contract employer coordination carries most of the compliance weight. Agriculture and grain handling (statewide)

Agriculture produced nearly half of Montana's 2024 workplace fatalities. The electrical version of that exposure is specific: grain elevators with aging motor control and dust (an arc flash inside a Class II location is an explosion initiator, not just a burn), center-pivot irrigation systems that combine 480 V, water, and field repairs, and augers, bins, and ladders moving under rural overhead lines. Almost nobody in this workforce is an electrician, which is exactly why the 70% non-electrical-worker statistic lives here. Elevator operators and ag processors: your maintenance staff need real qualification, and everyone else needs overhead-line awareness training that names distances, not vibes.

Hydro and rural electric cooperatives (statewide)

Montana's grid is defined by big hydro — dams on the Missouri, Madison, and Flathead systems — and by two dozen rural electric cooperatives covering distances that make "call for help" a 90-minute answer. Generation plant work behind the fence is 70E territory; line work is 1910.269; and small co-op crews cross that boundary weekly. The 2020 crane case above happened on a power plant alteration project, and the Sun River case shows the staffing reality. Forest products and manufacturing (western Montana)

Sawmills, plywood and post plants, and wood-products manufacturers from the Flathead to the Bitterroot run the classic 70E risk profile: aging MCCs, dusty environments, lean maintenance crews, and production pressure to troubleshoot energized. Add the state's other manufacturers — food processing, machinery, metal fabrication along the I-90 corridor — and you get the hardest test of the 2027 additional-person rule: a one-electrician night shift cannot lawfully execute an energized work permit that specifies PPE. Construction and tourism infrastructure (Bozeman, Missoula, Kalispell, Big Sky)

The Gallatin Valley and the Flathead are among the fastest-growing places in the interior West, and the construction boom — housing, resorts, medical facilities, and the commercial base that follows — is importing crews faster than anyone can train them. Temporary power, service upgrades on occupied buildings, boom trucks and pump trucks working near distribution lines, and multi-employer sites where nobody has exchanged hazard information in writing: this is where 1926 Subpart K citations and overhead-line contacts come from. If you build in Montana, the pre-job overhead-line survey and the host/contractor exchange are your two highest-leverage documents.

Public sector (cities, counties, school districts, state agencies)

As covered in Section 1: Montana's public employees are outside federal OSHA, but not outside the law — DLI's Safety & Health Bureau inspects public employers under the Montana Safety Culture Act and MCA Title 50, chapter 71. That's a meaningfully better position than public workers in states with no program at all — but a few hundred inspections a year across thousands of public entities means the inspection is not your safety program. A school district maintenance electrician or a city water plant operator gets exactly as much protection as the employer's written program provides. Adopting NFPA 70E by policy, funding the training, and keeping the documentation is what closes the gap.

06How the 2027 edition lands in Montana

Every change in the 2027 Implementation Guide applies here, but four hit Montana employers with particular force:

  • The additional-person requirement collides head-on with Montana's lone-worker reality: solo technicians on Bakken pads, one-electrician mills, single-person co-op service calls, and remote pump stations. If an energized task specifies PPE, a second person is part of the plan — which means dispatch practices and shift rosters have to change, not just permit forms. Across Montana distances, that's a scheduling problem to solve this year, not on the adoption date.
  • Host/contract employer coordination — Montana's mines, refineries, dams, and construction sites all run on contractors, and the 2020 crane case is the failure mode in miniature: two employers, one boom, one energized line. The 2027 edition tightens the documentation duty. If you can't produce the two-way hazard information exchange in writing, you don't have one.
  • The new solar article — utility-scale solar is spreading across Montana's high plains, and ranch, commercial, and co-op installations follow. Article 380 gives PV work its own requirements, and remote arrays are lone-worker sites by default — the two changes compound here.

07Montana employer compliance checklist

  • Map every operation to its enforcement regime — federal OSHA (Billings Area Office), MSHA mine property, 1910.269 utility work, or DLI public-employer coverage — and make sure crews can answer "which rulebook?" in the field
  • Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
  • Separate "State Electrical Board licensed" from "70E qualified" in your training matrix — verify every worker who interacts with energized equipment has documented, task-specific qualification
  • Make test-before-touch non-negotiable: verify the right source is open and test for absence of voltage on every conductor, every time — a lock on an unlabeled switch killed an experienced electrician here in 2025
  • Audit switchgear and disconnect labeling at every site — if which switch feeds which equipment "cannot be readily determined," fix that before the next maintenance task, not after
  • Extend overhead-line awareness training to non-electrical workers: ag crews, roofers and gutter crews, crane and boom operators, and anyone who moves ladders, pipe, or augers outdoors
  • Model the additional-person requirement against your actual rosters, lone-worker routes, and remote sites before the 2027 adoption date
  • Audit host/contract employer documentation at every mine, plant, dam, and construction site where contractors touch electrical equipment — two-way, in writing
  • For public entities: DLI's inspection program is a backstop, not a program — adopt 70E by policy and fund it
