Who enforces electrical safety in New Hampshire, what OSHA's Concord office actually investigates, what happened in real New Hampshire electrocution cases, what your Electricians' Board licenses require — and how the 2027 edition lands in a state built on defense manufacturing, hydro and biomass power, ski lifts, and thousands of small contractors.
01Who enforces electrical safety in New Hampshire
New Hampshire is a federal OSHA state for private-sector workplaces — there is no OSHA-approved state plan. Workplace electrical safety is enforced directly by federal OSHA through its Concord Area Office (J.C. Cleveland Federal Building, 53 Pleasant Street), the single office covering all ten New Hampshire counties under Region 1 (Boston). The rules applied are the familiar federal set: 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices.
Public-sector coverage is where New Hampshire differs from most federal-OSHA states, and it's worth getting right:
- "70E isn't law" doesn't protect you. OSHA cites the electrical work practice standards in Subpart S and uses NFPA 70E as evidence of what a reasonable employer would have done — for specific standards and under the General Duty Clause. Two of the five real cases below were cited directly under 1910.333, the safe-work-practices standard 70E exists to satisfy. When your program doesn't hold up against 70E after an incident, that gap becomes the citation narrative.
- Public employees are covered by the state — not by OSHA. Federal OSHA has no jurisdiction over New Hampshire's municipal, county, and state workers. But unlike Texas or Florida, New Hampshire doesn't leave that gap wide open: the NH Department of Labor's Safety and Training division enforces workplace safety law in the public sector under RSA 277, with public-employee safety and health rules in administrative chapter Lab 1400. On top of that, RSA 281-A:64 requires every New Hampshire employer with 15 or more employees — public or private — to maintain a written safety program, file a safety summary form with the department, and run a joint loss management committee. That written-program duty is a ready-made statutory anchor for a 70E-based electrical safety program. The honest caveat: NH DOL's inspection resources and penalty structure are not federal OSHA's, so for a town water department or school district, the quality of the written program still does most of the protecting.
- One area office doesn't mean low exposure. A single Concord office covers the whole state, so most inspections are driven by fatalities, hospitalizations, complaints, and referrals — exactly the visits you can't schedule for. And repeat-violation multipliers follow a contractor across every jobsite: in a state where one shop might touch fifty sites a year, one weak program can compound fast.
02New Hampshire by the numbers
New Hampshire's totals are small — 21 workplace deaths in 2023, 12 in 2024 (BLS CFOI) — and that's exactly the trap. Small numbers read as low risk, but the rates tell the real story: nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) carry electrical fatality rates roughly seven times the all-occupation rate of 0.11, and electricians as an occupation sit at 2.89 per 100,000 — twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024). New Hampshire's economy is disproportionately built from precisely those trades: small construction crews, line and generation work spread across rural territory, and maintenance staff keeping century-old mill buildings and mountain-top lift systems running.
Two national findings that should shape a New Hampshire program:
- 70% of workplace electrical fatalities happen to non-electrical workers — laborers, painters, tree crews, cooks, grounds staff, equipment operators. Look at the New Hampshire case list below: of the four electrocution deaths OSHA's Concord office has investigated since 2015, only one victim was an electrician. If your 70E training only reaches your electricians, it's missing most of the people who die from electricity here.
- Overhead line contact is the single largest killer — 49% of all U.S. electrical fatalities. In a heavily forested state with a huge tree care and landscaping sector, storm-response culture, and bucket trucks on every road after every ice storm, that national figure lands squarely on New Hampshire.
BLS publishes New Hampshire fatality counts by major event category; the "exposure to harmful substances or environments" category (3 deaths in each of 2023 and 2024) includes electricity along with heat, drugs, and chemical exposures, and CFOI suppresses cells too small to publish — so a clean statewide electrocution count isn't in the public tables. 03Real New Hampshire cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real, recent New Hampshire incidents, drawn from OSHA investigation records and news coverage. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. Every one of them started as an ordinary work order on an ordinary day.
Electrician electrocuted reaching into energized 480V switchgear — wastewater treatment plant
At 8:00 a.m. on August 24, 2022, a 59-year-old electrician employed by Keene contractor Fred H. Hamblet LLC (Hamblet Electric) was electrocuted when he reached into energized switchgear and contacted live parts operating at 480 volts at the North Swanzey wastewater treatment plant. OSHA's Concord office cited the company for four serious violations with initial penalties of $27,680, settled at $18,500 and paid in full, per reporting by NH Business Review.
this is the textbook Article 120 failure: no electrically safe work condition established before hands went inside the gear, and no verification (120.6's test-before-touch steps) on equipment everyone assumed was safe to reach into. If the work genuinely had to be done energized, Article 130 demanded justification (130.2), an energized work permit (130.3), shock and arc flash risk assessments (130.4, 130.5), and PPE (130.7). And note the setting: a municipal wastewater plant, where the host entity's own workers sit outside federal OSHA entirely (see Section 1) — the 110.5 host/contract information exchange is what connects the town's known hazards to the contractor's crew.

Tree worker electrocuted when his climbing strap contacted a high-voltage line
A 29-year-old employee of Leo's Tree Services & Landscaping Inc. was killed at midday on May 15, 2023, while removing tree limbs 25 to 30 feet up on Conant Road in Nashua, when his buck strap struck a high-voltage power line. OSHA issued three serious citations with $14,064 in initial penalties, reduced to $7,688 in settlement. Tree care shows up in the fatality data year after year, and it sits in a regulatory blind spot: small employers, seasonal crews, and almost no formal electrical safety training.
130.9 governs work near overhead lines — approach distances, and the planning duty to treat every conductor as energized until the utility confirms otherwise. The deeper failure is 110.4's qualification concept: a climber rigging limbs within strap's-reach of a primary conductor is doing electrical-exposure work whether or not anyone calls it that, and "qualified" means trained on those hazards, not experienced with trees. Painter in an aerial lift killed by a 32,000-volt line twelve feet from the building
A 37-year-old painter working for Prime Touch Services Inc. was descending in an aerial boom lift after finishing exterior trim work at a Cannongate Road building in Nashua when he contacted a 32,000-volt primary line running about twelve feet from the structure. Current entered at the back of his head and exited through the hand touching the lift railing. OSHA cited the company under 1910.332 and 1910.333 — the training and safe-work-practices standards — with $36,216 in initial penalties, reduced to $18,108. Read that citation list again: a painting company, cited under the electrical standards.
130.9's approach boundaries for overhead lines exist precisely for unqualified workers on elevated equipment — the boundary has to be established in the job plan before the boom goes up, because nobody judges twelve feet accurately from a moving bucket. This case is why 70E training scope can't stop at electricians: the pre-job briefing that would have saved this man was a painting crew's briefing. Under the 2027 edition's sharpened job safety planning emphasis, "we don't do electrical work" is not an exemption — it's the sound of an unmanaged hazard.

Sign technician electrocuted troubleshooting an energized sign at 1:30 a.m.
A 46-year-old employee of sign company Ink Outside The Box Inc. was electrocuted at 1:30 in the morning on July 31, 2015, while troubleshooting a faulty electrical sign while it was energized at the state liquor outlet on I-95 southbound in Hampton. OSHA's investigation record files the case under lockout/tagout. Night work on signage is a classic New Hampshire service call — and diagnostic work is where "it has to be live to troubleshoot" becomes a fatal habit.
70E does allow energized diagnostics — but never casually. Troubleshooting still requires the 130.4 shock and 130.5 arc flash risk assessments, PPE per 130.7, and a worker qualified for the task under 110.4; and the moment diagnosis turns into repair, Article 120's electrically safe work condition becomes the rule again. Add the 2027 lens: a lone technician on an energized task at 1:30 a.m., with no one in sight — exactly the staffing pattern the new additional-person requirement was written to end.

Electrical contractor cited for un-locked-out circuit and fall hazards — no injury required
OSHA doesn't wait for a body. After a December 2014 inspection of Daniels Electric Corp. at a restaurant jobsite on Loudon Road in Concord, OSHA cited the electrical contractor for a willful fall protection violation and two serious violations — including exposing an employee working on a rooftop light fixture to shock and burn hazards because the circuit had not been locked out and could have been unintentionally re-energized. Proposed penalties: $40,000. The area director's line from the release is the whole lesson: a fall from 12 feet can kill or disable a worker for life — so can an electric shock.
Article 120's lockout/tagout program is what stands between "I switched it off" and an electrically safe work condition — de-energized isn't safe until it's locked, tagged, and verified dead under 120.6. And notice who got cited: a licensed electrical contractor. A license and a van full of experience satisfy neither OSHA nor 110.3's demand for an actual written electrical safety program with procedures your crews demonstrably follow.

The pattern across all five: not one exotic failure. A hand into gear nobody verified dead. A climbing strap a few inches too close. A boom lift descending past a primary line. A live sign at 1:30 a.m. A rooftop circuit nobody locked out. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments.
04Electricians' Board licensing and what it requires
New Hampshire licenses electricians at the state level through the Electricians' Board, administered under the Office of Professional Licensure and Certification (OPLC) in Concord. The Board issues apprentice, journeyman, master, and high/medium-voltage classifications. Two facts matter for your electrical safety program:

The licensing gap is the single most misunderstood point I encounter in class. A New Hampshire journeyman or master license certifies competence in installation per the NEC. OSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock hazards, arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. A master's license does not make someone a qualified person under 70E — the Daniels Electric and Hamblet cases above both involved licensed electrical contractors.
05Industry by industry: where 70E does the work in New Hampshire
Defense electronics and advanced manufacturing (Nashua–Merrimack corridor)
Southern New Hampshire runs one of New England's densest advanced-manufacturing corridors — anchored by BAE Systems' electronic-systems operations in Nashua and a supply web of aerospace component, precision machining, and electronics shops along Route 3 and 101A. Electrically, these plants mean aging and expanding distribution living side by side, dense control and test-bench power, and lean maintenance crews under production pressure. The recurring 70E problems: energized troubleshooting on test and production equipment without documented 130.4/130.5 risk assessments, and second- and third-shift staffing that can't satisfy the 2027 additional-person requirement when an energized permit specifies PPE. Hydro, biomass, and the North Country grid
New Hampshire's generation fleet is distinctive: run-of-river hydro stations strung down the Merrimack, Androscoggin, and Connecticut rivers — many of them small, remote, and thinly staffed — plus wood-fired biomass plants in the North Country. Hydro and biomass work straddles the 1910.269 utility rules and 70E's premises-wiring scope, and the jurisdictional seam is a live question for every plant electrician and contractor who touches both generation equipment and station service power. Remote single-operator hydro stations are exactly where the 2027 additional-person requirement rewrites the staffing math: a lone technician opening an energized panel at an unmanned dam is no longer a compliant plan. Ski areas and seasonal resort infrastructure
The White Mountains resort economy is an electrical program hiding in plain sight: lift drive motors and control systems on exposed terrain, snowmaking pump houses and compressor plants, mountaintop distribution runs, and lodging infrastructure — much of it maintained in the shoulder seasons by small year-round crews, then operated flat-out through winter by seasonal staff. Lift electrical maintenance compresses into pre-season windows where the pressure to troubleshoot energized is enormous. And note the ownership wrinkle: Cannon Mountain is state-operated and Gunstock is county-owned, which puts their maintenance staff under the NH Department of Labor's public-sector rules rather than federal OSHA (see Section 1) — their written 70E-based program is carrying the load.
Mill rehabs and the small-contractor construction economy
New Hampshire construction is a small-shop economy — thousands of contractors under twenty employees — and a striking share of the work happens inside 19th-century mill buildings: Manchester's Millyard, Nashua's and Dover's mill districts, and main-street blocks across the state being converted to housing, labs, and offices. Rehab electrical work is seam work: knob-and-tube and cloth-insulated conductors landing in modern panels, services upgraded in stages, and circuits whose labeling died generations ago. That makes 120.6's verification steps — test before touch, every conductor, every time — the working heart of the program, because in a mill rehab "that circuit should be dead" is a guess, not a fact. For small shops, RSA 281-A:64's written-safety-program requirement (15+ employees) is the statutory hook: if you must have a written program anyway, build the electrical section on 70E.
Data centers and southern New Hampshire's power play

Whatever the buildout pace, the compliance pattern is already familiar from every other market: UPS and switchgear inspection under uptime pressure, performed by contractors, on equipment nobody wants to de-energize — the exact scenario that killed an electrician in the North Swanzey case above, just at higher incident energy. Public sector — and the shipyard next door
New Hampshire's cities, towns, school districts, counties, and state agencies are outside federal OSHA but inside the NH Department of Labor's public-sector safety jurisdiction (RSA 277 and the Lab 1400 rules), with the RSA 281-A:64 written-program and joint-loss-management-committee duties on top. That's a real backstop — but state enforcement is not federal enforcement, and the North Swanzey case happened at a municipal plant. Adopting NFPA 70E by policy, in the written program the statute already requires, is the highest-leverage move available to a New Hampshire public entity. One more Seacoast peculiarity: the Portsmouth Naval Shipyard, workplace to thousands of New Hampshire residents, sits on federal property across the river — a Navy industrial facility whose civilian workforce falls under the federal agency safety program requirements rather than either state or private-sector OSHA enforcement. Contractors working inside the yard carry their own OSHA obligations with them through the gate.

06How the 2027 edition lands in New Hampshire
Every change in the 2027 Implementation Guide applies here, but four hit New Hampshire employers with particular force:
- The additional-person requirement lands hardest on exactly what New Hampshire has most of: one-tech night shifts in southern-tier plants, unmanned hydro stations, mountain maintenance crews, and solo service calls like the 1:30 a.m. Hampton sign job. Staffing plans, not just permits, have to change.
- Host/contract employer coordination — a small-contractor economy means nearly every energized task involves a host and a contractor. The North Swanzey case is the failure mode; the 2027 edition tightens the documentation duty. If you can't produce the two-way hazard information exchange in writing, you don't have one.

07New Hampshire employer compliance checklist
- Confirm your reporting path to OSHA's Concord Area Office — and whether any of your operations touch 1910.269 utility work at generation or distribution assets
- Put your written safety program's electrical section against the 2027 edition — RSA 281-A:64 requires the written program; make it one that survives an investigation, or build one now
- Separate "Board licensed" from "70E qualified" in your training matrix — verify every worker who interacts with energized equipment has documented, task-specific qualification
- Extend awareness-level training to non-electrical workers: painters, tree crews, maintenance generalists, lift operators, and anyone using elevated equipment near overhead lines — three of the four NH electrocution deaths since 2015 were not electricians
- Kill the lone-worker energized service call: model the 2027 additional-person requirement against real rosters — night shifts, remote hydro stations, mountain crews, after-hours service work
- Audit host/contract employer documentation everywhere contractors touch your electrical equipment — two-way, in writing, including municipal facilities
- In mill rehabs and older buildings, make 120.6 verification non-negotiable: test before touch, every conductor, every time — labels and drawings from 1985 are not evidence
- For public entities: NH DOL coverage is real but thin — adopt 70E by policy inside your RSA 281-A:64 written program and fund the training behind it
