Who enforces electrical safety in North Dakota, what OSHA's Bismarck office actually cites, what happened in real North Dakota electrocution cases, what a State Electrical Board license does and doesn't cover — and how the 2027 edition lands in the Bakken, in Coal Country, on the wind fleet, and at every co-op elevator in between.
01Who enforces electrical safety in North Dakota
North Dakota is a federal OSHA state for private-sector workplaces — there is no North Dakota state OSHA plan. Workplace electrical safety is enforced directly by federal OSHA, applying 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices.
The entire state is served by one federal OSHA office: the Bismarck Area Office (807 E. Main Ave., Bismarck), under Region 8 in Denver. One office. Fifty-three counties. An oil patch three hours from the office door, wind sites farther than that, and grain elevators in every town on the map. That coverage math matters for how you should think about compliance here:
- Low inspection density is not protection — it's a trap. With a single area office covering a state this size, OSHA in North Dakota is overwhelmingly reactive: fatalities, hospitalizations, amputations, and complaints drive the inspection docket. That means the first time a compliance officer sees your electrical program is usually the week after your worst day. Every case in Section 3 below entered the OSHA system exactly that way. "70E isn't law" doesn't protect you either — OSHA cites Subpart S and the General Duty Clause, and uses NFPA 70E as the measure of what a reasonable employer would have done.
- Public-sector workers have no OSHA coverage at all. Because North Dakota has no state plan, employees of cities, counties, school districts, and state agencies are not covered by OSHA. Workforce Safety & Insurance (WSI), the state's exclusive workers' compensation fund, offers safety programs and premium incentives — but incentives are not enforcement, and no WSI program substitutes for an electrical safety standard. A municipal utility electrician in Grafton or a school district maintenance tech in Minot has exactly one layer of protection: the employer's own written, 70E-based program.
- The utility/premises boundary runs through half the state's electrical work. Rural electric cooperatives and their contractors work under 1910.269 on the lines and under Subpart S/70E on substations, shops, and member-side equipment. If your crews touch both sides of the service point — and in co-op country most do — your program must say which rule set governs which task, and your people must be able to answer that in the field.
02North Dakota by the numbers
North Dakota's workforce is small, but its fatal injury rate is persistently among the worst in the country — 6.8 deaths per 100,000 full-time workers in 2024 NEEDS SME REVIEW confirm "roughly double the national rate" against the final national 2024 CFOI rate before launch — because the state's economy concentrates in exactly the industries that kill people: agriculture, oil and gas extraction, transportation, and construction. Agriculture alone accounted for 9 of the 28 deaths in 2024. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) carry electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).
Two more national findings that should shape a North Dakota program:
- 70% of workplace electrical fatalities happen to non-electrical workers — laborers, drivers, mechanics, grain handlers, equipment operators. Look at the cases below: a mechanical technician, a concrete crew, a feed delivery driver, a carpenter. Not one licensed electrician among the dead. If your 70E training only reaches your electricians, it's missing the people this state actually loses.
- Nearly half of electrical fatalities are overhead line contacts — and North Dakota is an overhead-line state end to end: augers and grain legs at elevators, feed bins on flatbeds, boom trucks on wellsites, irrigation pipe, seasonal crews who've never had a minute of electrical awareness training. Two of the five cases below are exactly this event.
BLS publishes North Dakota fatality counts by major event category; in a state this small, the electrocution count swings between zero and a handful from year to year — the 2024 CFOI release recorded no deaths in the "exposure to harmful substances or environments" category, while the OSHA case file in Section 3 shows electrical fatalities in 2015, 2017, 2019, 2021, and 2022. 03Real North Dakota cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real North Dakota incidents, every one drawn from federal OSHA's own investigation and inspection records out of the Bismarck Area Office. Each maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.
Mechanical technician electrocuted replacing a combustion air ventilator — Valley Service Mechanical
A 24-year-old mechanical technician was electrocuted while replacing a combustion air ventilator at a Fargo site. OSHA's investigation found he contacted live electrical energy from a capacitor while performing the replacement without lockout procedures. OSHA cited Valley Service Mechanical, LLC under 1910.147 — the lockout/tagout standard — including failures in energy control procedures and periodic inspection, with $21,116 in initial penalties (settled at $14,502).
this is Article 120 front to back. The eight-step verification in 120.6 exists precisely for equipment like this — it requires releasing or controlling stored electrical energy, because a capacitor doesn't care that the disconnect is open. And note who died: a mechanical tech, not an electrician. Article 110.4's training requirement extends to every worker whose job puts them on energized equipment, whatever their trade. A 24-year-old servicing HVAC equipment is squarely inside a 70E program's scope — or should be.

Flagpole contacts 14,400-volt line during installation — one worker killed, one burned — Eng Curbing and Concrete
Two workers were erecting a 30-foot flagpole near Mandaree, in the heart of the Fort Berthold oil patch, when the pole contacted a 14,400-volt overhead line 28 feet up. One worker was electrocuted and died; his coworker sustained serious electrical burns. OSHA cited Eng Curbing And Concrete LLC under 1926.416(a) — failure to protect employees from electrical hazards and failure to determine energized circuit locations before work — and 1926.21(b)(2), failure to instruct employees in hazard recognition. Penalties totaled $27,306.
Section 130.9 governs work near overhead lines, and the limited approach boundary for unqualified persons is the line this crew crossed — a 30-foot conductive pole under a 28-foot line is a contact waiting for a gust of wind. The failure OSHA named first, though, was planning: nobody determined where the energized parts were before work began. The job safety planning the 2027 edition emphasizes is a five-minute conversation that would have moved this pole, or de-energized this line, or killed this task.

Escalator technician contacts open controller cabinet during monthly maintenance — Thyssenkrupp Elevator
A service technician performing monthly escalator maintenance in downtown Bismarck opened a floor hatch and worked prone in the upper pit, applying lubricant. The escalator's power supply was not locked out. His hand contacted an open controller cabinet; he suffered electrical burns to his hand and abdomen and died six days later. OSHA cited Thyssenkrupp Elevator Corporation under 1910.303(b)(7) with an initial penalty of $13,260. NEEDS SME REVIEW inspection record shows current penalty of $0 after contest — confirm final disposition language before publication.
routine maintenance is where "we do this every month" quietly replaces Article 120. An electrically safe work condition isn't a judgment call reserved for big jobs — 110.2 makes it the default for work within the limited approach boundary, and an open, energized controller cabinet inches from a prone worker's hand is inside every boundary that matters. Sophisticated national employers are not exempt from ordinary failures; the procedure that matters is the one followed in the pit in Bismarck, not the one in the binder at headquarters.

Carpenter electrocuted adjusting a sink basin on a residential remodel — Civil Contracting Services
A 30-year-old carpenter working a residential alteration project in Grand Forks was adjusting a sink basin when he grabbed a grounded copper pipe while contacting a live electrical part — completing the circuit through his body. He was electrocuted. OSHA cited Civil Contracting Services, Inc. under 1926.416(a) for failing to protect employees from electric shock and failing to locate energized circuits before work, plus a training-related violation; initial penalties were $13,691 (settled at $8,000).
on a remodel, every wall is energized until verified otherwise — Article 120's verification principle (test before touch, every conductor, every time) applies to demolition and alteration work just as much as to panel work. And the shock risk assessment in 130.4 is exactly the tool that flags the deadly geometry here: live parts within reach of grounded plumbing. A carpenter will never perform that assessment himself. Someone qualified has to do it for the site — that's what Article 105's employer responsibilities mean in practice.

Driver electrocuted raising a feed bin into a 14.4 kV line — AWI Transport
A driver delivering a feed bin near Killdeer was operating his flatbed trailer's controls to raise the bin into position when it contacted a 14.4 kV overhead power line. He was electrocuted at the controls. OSHA cited AWI Transport LLC under 1910.333(c)(3) — the minimum clearance rule for unqualified persons working near overhead lines — and, tellingly, under 1910.332(b)(1): the company had never given its drivers electrical safety training at all.
this is rural North Dakota's signature electrical fatality: farm delivery, raised load, overhead distribution line. Section 130.9's approach boundaries for overhead conductors, and awareness-level training under 110.4 for every worker who raises anything — beds, booms, bins, augers — near lines. The citation pair says it plainly: the clearance violation killed him; the training violation explains why nobody saw it coming. The pattern across all five: not one victim was a licensed electrician, and not one failure was exotic. A capacitor nobody discharged. A pole raised under a line nobody looked at. A pit nobody locked out. A wall nobody tested. A bin raised into a conductor nobody briefed the driver about. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments.
04State Electrical Board licensing and what it requires
North Dakota licenses electricians at the state level through the North Dakota State Electrical Board (NDSEB) — and for a small state, it runs one of the tighter regimes in the country. Classifications include registered apprentice, journeyman (8,000 hours over at least three years), Class B (farmstead and small-town residential wiring, limited to communities of 2,500 or fewer), power limited electrician, and master — with the master tier split into contracting master, master of record, and non-contracting master. Beyond licensing, the Board runs a statewide wiring certificate ("e-cert") and inspection system: the supervising master, Class B, or power limited electrician must file a certificate with the Board and the power company before work begins, and the Board's own inspectors cover inspection districts across the state. Three facts matter for your electrical safety program:

The licensing gap is the point I hammer hardest in North Dakota classes. This state inspects more of its electrical work than almost any federal-OSHA state — farm buildings, houses, commercial jobs, all under Board e-certs — and that thoroughness breeds a dangerous inference: "our electrical work is inspected, so our electrical safety is handled." An NDSEB license certifies installation competence per the NEC. OSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock and arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. A contracting master's license does not make anyone a qualified person under 70E, and none of the five workers in Section 3 was killed by an installation defect a Board inspector would have caught.
05Industry by industry: where 70E does the work in North Dakota
Bakken oil and gas (Williston, Watford City, Dickinson)
The Williston Basin remains one of the country's major oil-producing regions, and its electrical reality is unforgiving: wellsite and midstream equipment in classified locations where an arc is an ignition source; VFDs, generation packages, and gathering-system electrical spread across lease roads an hour from anywhere; and a contractor-on-contractor workforce where the operator, the electrical contractor, and three service companies may all touch the same panel in a week. That makes Article 110.5's host/contract employer information exchange the load-bearing wall of Bakken compliance — and the 2027 edition tightens it. Add the cold: at −30°F, arc-rated layering, glove dexterity, and the temptation to leave covers off "just for this task" are all program issues, not personal choices. Lignite power generation (Coal Country — Beulah, Underwood, Center)
North Dakota's lignite belt runs mine-mouth generation the rest of the grid leans on all winter: stations and the synfuels complex around Beulah, Underwood, and Center, fed by draglines and conveyors with serious medium-voltage distribution behind them. Generation O&M lives on the 1910.269/Subpart S boundary — switchyard and generation tasks on one rule set, shop and balance-of-plant work under 70E — and outage season compresses high-energy switching, breaker racking, and testing into weeks. Those are permit-and-boundary tasks under 130.2 and 130.3, at some of the highest incident energies in the state, executed by crews supplemented with traveling outage contractors who need the host/contract exchange in writing before day one. Wind energy (statewide, concentrated along the Missouri Plateau)
Wind now supplies roughly a third of the electricity generated in North Dakota NEEDS SME REVIEW confirm current EIA wind share figure, and the fleet's maintenance model is the 2027 edition's hardest test case: technicians dispatched alone or in pairs to turbines an hour from the O&M building, working 690 V systems, converter cabinets, and collection-system gear in all weather. Agriculture, grain elevators, and sugar beets (Red River Valley and everywhere else)
Every North Dakota town has a co-op elevator, and the Red River Valley adds sugar beet processing campaigns that run flat-out from fall harvest into winter — plants full of motors, MCCs, and centrifuges maintained around the clock by lean crews. Two distinct 70E problems live here. In the plants and elevators: aging distribution, dust (a fire and combustible-atmosphere issue layered on the arc hazard), and maintenance electricians working night shifts alone — the exact staffing pattern the 2027 additional-person rule breaks. Outside: overhead lines over scale approaches, bin sites, and farmyards, contacted by augers, raised truck beds, and delivery equipment operated by workers with zero electrical training — the Killdeer case is the archetype, and 49% of national electrical fatalities say it isn't rare. Data centers (Ellendale, Jamestown corridor, and near cheap power)
Cheap wind power and cold air have pulled crypto and AI data center construction into North Dakota — including the large-scale AI campus buildout at Ellendale that has made a town of a thousand people a fixture of national infrastructure news. These projects import big-market electrical risk into small-market labor pools: commissioning phases where 1926 Subpart K hands off to 1910 Subpart S around progressively energized switchgear, UPS and battery systems under Article 360, and uptime pressure that invites energized inspection work. The national case file is blunt about how that ends when nobody establishes an electrically safe work condition first. Rural electric co-ops and the public sector
North Dakota's distribution map is cooperative country — private, member-owned utilities running some of the longest line miles per meter in America. Co-ops are covered by federal OSHA: line work under 1910.269, substation, shop, and metering work under Subpart S with 70E as the practice standard, and the boundary between the two defined — or not — by the co-op's own program. Municipal utilities and public entities are a different story: as covered in Section 1, no state plan means no OSHA coverage at all for city, county, school, and state workers. A public entity that adopts NFPA 70E by policy gives its electricians and maintenance staff the same protection private-sector workers get; one that doesn't leaves the gap entirely open. 06How the 2027 edition lands in North Dakota
Every change in the 2027 Implementation Guide applies here, but four hit North Dakota employers with particular force:
- The additional-person requirement collides with this state's defining working condition: distance. Lone wind techs, one-electrician elevator shifts, solo service calls across the oil patch — an energized work permit specifying PPE now requires a second person, and in North Dakota that's a dispatch and staffing decision, not a paperwork one. Model it against real rosters before the adoption date.
- Host/contract employer coordination — the Bakken, the lignite outage cycle, and the data center buildout all run on layered contractors. The Fargo case shows the pattern: the worker who dies is usually the contractor's. If you can't produce the two-way hazard information exchange in writing, you don't have one.
- The new solar article (380) — utility-scale solar and storage are following wind onto the North Dakota grid, and PV's can't-turn-it-off hazard model is new to crews raised on lockout. Get ahead of it before the first big array energizes.

07North Dakota employer compliance checklist
- Confirm your sites' relationship to the Bismarck Area Office and identify any operations that touch 1910.269 utility work — especially co-ops, municipals, and generation contractors
- Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
- Separate "NDSEB licensed" from "70E qualified" in your training matrix — a Board license and a filed e-cert are installation credentials, not qualification for energized work
- Extend awareness-level training to non-electrical workers: mechanics, millwrights, drivers, grain handlers, seasonal crews, and anyone who raises equipment near overhead lines
- Treat overhead-line contact as a planning problem: map lines at elevators, scale approaches, bin sites, and laydown yards, and brief every delivery and boom operation against 130.9 boundaries
- Audit host/contract employer documentation everywhere contractors touch your electrical equipment — wellsites, plants, turbines, data center builds — two-way, in writing
- Model the additional-person requirement against actual shift rosters, lone-worker dispatch, and remote sites before the 2027 adoption date
- Build cold-weather PPE into the program: arc-rated layering and the glove system have to survive January, or the field will quietly abandon them
- For public entities: adopt 70E by policy and fund the program — no OSHA coverage means no one else is coming
