NFPA 70E Compliance in South Carolina

Who enforces electrical safety in South Carolina, what SC OSHA actually cites, what happened in real South Carolina electrocution cases, how the state's contractor-based licensing works — and how the 2027 edition lands in the state's automotive, aerospace, tire, port, and data center economy.

01Who enforces electrical safety in South Carolina

South Carolina is a full state-plan state. Workplace safety and health is enforced by South Carolina OSHA (SC OSHA), a division of the state Department of Labor, Licensing and Regulation (LLR), headquartered at the Synergy Business Park in Columbia. South Carolina was the first state in the country to receive initial approval to run its own OSHA plan — on November 30, 1972 — and it has run enforcement here ever since. SC OSHA has adopted the federal standards essentially identically: 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe electrical work practices. The state's handful of unique standards (spray finishing, respiratory protection, powered industrial trucks, excavations) don't change the electrical picture.

Three consequences of the state-plan arrangement that South Carolina employers routinely get wrong:

  • Public-sector workers ARE covered here. Unlike federal-OSHA states such as Texas or Florida, the South Carolina plan covers state and local government workplaces — cities, counties, school districts, special purpose districts, state agencies, and public universities. Two of the fatality cases below were at public employers: a regional water system and the Medical University of South Carolina. If you run EHS for a South Carolina public entity, SC OSHA can and does inspect you, cite you, and fine you after an electrical fatality.
  • Jurisdictional seams run right through the state's biggest employers. Federal OSHA — not SC OSHA — retains maritime employment (shipyard work and longshoring at the Port of Charleston's terminals), military bases, and designated federal facilities including the Savannah River Site. A contractor whose crews work the port container yards, a Charleston-area fab shop, and a municipal pump station is answering to two different enforcement agencies in the same week. Your program has to say which rule set owns which site.
  • Don't calibrate your program to SC OSHA's penalty levels. In the fatality cases below, total penalties ran from about $1,300 to $3,000 — a small fraction of what federal OSHA proposes for comparable events. A cheap citation after a death is not a cheap event: the wrongful-death exposure, the workers' comp consequences, and the citation narrative in civil discovery all dwarf the fine. If your electrical safety budget is sized to the penalty risk, it's sized to the wrong number.

South Carolina recorded 103 fatal work injuries in 2024. Construction accounted for 24 of them — 16 in specialty trade contracting, which is where most electrical work lives — and the "exposure to harmful substances or environments" category, which includes electricity, claimed 24 lives, nearly a quarter of the state total. Eight of those deaths were exposure to electricity, a strikingly high share for a state this size. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) carry electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).

Two more national findings that should shape a South Carolina program:

  • 70% of workplace electrical fatalities happen to non-electrical workers — laborers, tree trimmers, equipment operators, HVAC mechanics, grounds crews. Look at the five South Carolina cases below: a skidder operator, a water-system maintenance worker, a landscaping crew member, an equipment service technician, a facilities worker. Not one held the title "electrician." If your 70E training only reaches electricians, it's missing the people who actually die here.
  • Hispanic and Latino workers carry a disproportionate share of electrical fatalities (0.18 per 100,000 vs. 0.10 for white non-Hispanic workers, per ESFI). South Carolina's construction, landscaping, and agricultural workforces include large Spanish-speaking crews. If your training isn't delivered effectively in Spanish, it isn't delivered.

03Real South Carolina cases: what the citations say

Abstract risk doesn't change behavior — cases do. These are real, recent South Carolina incidents, drawn from SC OSHA fatality investigation records in the federal OSHA enforcement database. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.

Anderson County July 2024 Fatality $1,280 in SC OSHA penalties

Water-system worker electrocuted cutting a live wire with non-insulated cutters — Anderson Regional Joint Water System

A 23-year-old employee of the Anderson Regional Joint Water System was troubleshooting an air-conditioning unit at the Clemson Booster Station on July 18, 2024. While cutting a wire under the fan guard with a non-insulated wire cutter, he contacted an energized conductor and was fatally shocked. SC OSHA's investigation produced five citations: three serious lockout/tagout items under 1910.147 (energy-control procedures, training, and application), a serious violation of 1910.335 for working around exposed energized parts without insulated tools and protective equipment, and a PPE hazard-assessment item. Total penalties: $1,280.

this is Article 120 in its purest form — establish an electrically safe work condition before you cut anything — plus 130.7's insulated tools and PPE and 110.4's training duty. Note the employer: a regional public water system, inspected and cited by SC OSHA because South Carolina's plan covers public employees (see Section 1). And note the number: five citations, one dead 23-year-old, $1,280. The fine is not the reason to run a program.

Charleston July 2022 Fatality $3,000 in SC OSHA penalties

Facilities worker dies taking amperage readings inside a heat-damaged panel — Medical University of South Carolina

A facilities employee at the Medical University of South Carolina responded to a work order reporting heat damage to the insulation inside an electrical panel. While measuring amperage inside the panel with a clamp meter on July 8, 2022, he suffered cardiac dysrhythmia from electric shock and collapsed; he was pronounced dead at the scene. SC OSHA cited three serious violations — 1910.333(a)(2) for energized work without safe work practices, 1910.335(a)(1) for lack of electrical PPE, and 1910.132(f)(1) for PPE training — at $1,000 each, resolved by informal settlement.

diagnostic work is energized work. Taking readings inside a panel puts you inside the restricted approach boundary of live parts, which means a shock risk assessment (130.4), an arc flash risk assessment (130.5), and the PPE those assessments demand (130.7) — every time, even for "just a measurement." The heat-damaged insulation that generated the work order was itself evidence of an abnormal condition, which should raise the risk assessment, not lower the guard. And again: a state institution, cited by SC OSHA. Public employers in this state carry the same duties.

Spartanburg February 2024 Fatality Service contractor

Field service technician electrocuted servicing an aerial lift parked under power lines — United Rentals

A 26-year-old field service technician for United Rentals was dispatched to a customer site in the Spartanburg area on February 14, 2024 to service an aerial lift. The lift was positioned beneath overhead power lines, and he was working alone; a coworker found him unresponsive in the boom after seeing black smoke. The lift had made contact with the overhead lines while being serviced.

Article 130's overhead-line provisions (130.9) exist because elevated equipment near lines is the single largest killer in workplace electrical safety — 49% of all U.S. electrical fatalities. But the deeper failures are 110.5's host/contract employer exchange — who at the customer site told the visiting technician where the lines were and where the lift could safely be exercised? — and the lone-worker problem the 2027 edition attacks head-on. A traveling service tech, alone at someone else's site, is the exact person your host-employer procedures are supposed to protect.

Seabrook Island June 2024 Fatality Tree care / landscaping

Landscaping worker holding an aluminum ladder killed when a coworker's pole saw hit a power line

On June 28, 2024, a 31-year-old employee of landscaping company Pleasant Places Inc. was steadying an aluminum ladder at a tree-trimming job on Seabrook Island while a coworker trimmed with a pole saw. The saw contacted an overhead power line, current passed through the ladder, and the worker holding it was killed. Tree care appears year after year in the national data — grounds maintenance workers die from electricity at many times the all-occupation rate — and the industry sits in a training gap: small employers, seasonal crews, rarely reached by any formal electrical safety instruction.

minimum approach distances for unqualified persons near overhead conductors (130.9 and Article 130's limited approach boundary), conductive-object handling, and pre-job planning that treats every line as energized. Nobody on this crew was an electrical worker — which is precisely the point of the 70% statistic in Section 2. If you hire landscape or tree contractors at a South Carolina facility, verifying their electrical awareness training is part of your host-employer duty under 110.5.

Rural South Carolina August 2024 Fatality Logging

Skidder operator electrocuted when a felled line lands on his machine — Lewis Logging LLC

On August 30, 2024, a skidder operator for Lewis Logging LLC was fueling his machine from a service truck near an overhead power line. Across the landing, a loader operator moving dead wood toward a truck struck the energized line; it fell and contacted the skidder's arm. The operator was found under the machine, dead of high-voltage electrocution injuries. Timber is a top South Carolina agricultural commodity, and rural distribution lines cross log decks, field edges, and farm lanes all over the state.

the job-safety-planning discipline the 2027 edition emphasizes: before equipment moves on a site with overhead lines, someone has to walk the site, map the lines, and set machine exclusion zones (130.9's approach distances for equipment). The worker who died wasn't the one who hit the line — which is why individual caution can't substitute for a plan that governs the whole crew. Logging, agriculture, and site-clearing crews belong inside your electrical awareness program even though none of them will ever open a panel.

The pattern across all five: not one of these was an exotic failure. A wire cut with the wrong tool. A reading taken in a damaged panel. A lift serviced under lines. A ladder held in the wrong spot. A machine fueled near a conductor. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments. And notice: within twelve weeks in the summer of 2024, SC OSHA opened three separate electrocution fatality investigations.

04Licensing in South Carolina — and the gap it leaves

South Carolina licenses businesses, not individual electricians. Commercial electrical work requires a contractor license from LLR's Contractor's Licensing Board — a mechanical contractor license with an electrical classification, qualified by a trade exam — and residential electrical work runs through LLR's Residential Builders Commission as a residential specialty trade. There is no statewide journeyman or master electrician card; some cities and counties administer their own journeyman/mechanic examinations and cards, and requirements vary by jurisdiction. The qualification gap is wider in South Carolina than in most states. In Texas, employers at least wrongly assume a state journeyman license equals a "qualified person." Here there's no individual license to lean on at all — which means OSHA's and 70E's qualified-person concept (demonstrated training on the specific hazards, boundaries, PPE, and verification skills for the tasks and equipment involved, per 110.4) rests entirely on the employer's own program and records. If your documentation can't show who is qualified for what, nobody can show it for you.

05Industry by industry: where 70E does the work in South Carolina

Automotive manufacturing (Upstate I-85 corridor and the Midlands)

BMW's Spartanburg plant in Greer is the company's largest in the world and the largest automotive exporter by value in the United States; Volvo builds cars at Ridgeville; Scout Motors is standing up a new EV plant at Blythewood; and hundreds of tier suppliers line I-85. Electrically, these sites combine dense robotics and MCC lineups, high-voltage EV battery and vehicle systems that add dc hazards (Article 310) and battery-specific requirements (Article 360) to the familiar ac work, and model-changeover and expansion projects that flood plants with contractors — which puts Article 110's host/contract employer duties at the center of compliance. A down body-shop cell at 2 a.m. with one maintenance electrician on shift is exactly where the 2027 additional-person requirement bites. Full treatment: NFPA 70E for Manufacturing.

Aerospace (North Charleston)

Boeing's North Charleston campus assembles the 787, surrounded by a growing supplier base. Aerospace maintenance work runs on tight production cadence, extensive contractor support, and equipment — autoclaves, paint systems, tooling power, facility switchgear — where "we can't stop the line" pressure meets energized troubleshooting. The discipline that protects these sites is procedural: an energized work permit process (130.3) with real teeth, risk assessments that don't get pencil-whipped (130.4, 130.5), and commissioning plans for every expansion that mark the day construction power becomes plant power.

Tires, textiles legacy, and advanced materials (Greenville, Sumter, Chester County)

South Carolina makes more tires than any other state: Michelin's North American headquarters and multiple plants around Greenville, Continental in Sumter, Giti in Chester County. Tire and rubber plants pair large motor loads, curing presses, and heat with round-the-clock schedules — and the state's textile-mill legacy means plenty of manufacturers still run in buildings whose distribution gear predates every edition of 70E. Aging switchgear that can't be verified de-energized without heroics is a maintenance problem (Chapter 2) before it's a work-practice problem — and incident-energy levels on old, poorly maintained gear are routinely worse than the label suggests. Port of Charleston, inland ports, and logistics

The Port of Charleston is one of the busiest container gateways on the East Coast, with inland ports at Greer and Dillon and warehouse belts spreading along I-26 and I-85. Here's the seam most safety managers miss: longshoring and maritime work at the terminals falls under federal OSHA, not SC OSHA — one of the few carve-outs from the state plan. A contractor maintaining crane electrical systems, reefer racks, or terminal substations may cross between federal maritime jurisdiction and SC OSHA general industry in a single contract. Your program must name which standards apply where, and your crews must know the answer in the field. The warehouse side — conveyor systems, charger rooms full of lift-truck batteries, rooftop solar — is squarely SC OSHA territory and squarely 70E work.

Energy: nuclear, solar, and the EV-battery buildout

The Savannah River Site near Aiken is a federal enclave — DOE rules and federal oversight, outside SC OSHA's jurisdiction, though its thousands of subcontract workers move between the site and state-plan workplaces. Dominion's V.C. Summer station still operates its original unit (the abandoned Units 2–3 expansion remains the state's cautionary tale), and utility-scale solar is spreading across former farmland while Redwood Materials builds battery-materials capacity at Camp Hall and battery plants rise to feed the automotive corridor. The 2027 edition's dedicated solar article (Article 380) and battery article (360) land directly on this buildout — and remote solar sites plus the additional-person requirement change staffing math: a lone technician on an energized combiner task is no longer a compliant plan. Data centers (Berkeley County and beyond)

Google has operated and repeatedly expanded a major data center campus in Berkeley County since 2007, and new builds keep announcing across the state as power-hungry projects chase the grid. Data center electrical work concentrates the classic failure mode: inspection and testing on UPS systems, switchgear, and distribution under uptime pressure, performed by contractors, on equipment nobody wants to de-energize. Every one of those tasks needs the risk-assessment-first discipline of Article 130 — and lean critical-facilities teams need to model the 2027 additional-person requirement before it models them. Public sector (cities, counties, districts, state agencies)

Unlike Texas or Florida, South Carolina's public employers are fully covered by SC OSHA — and the cases above prove enforcement is real: a regional water system and a state medical university were both cited after electrocution deaths. But look at the penalties: $1,280 and $3,000. If you administer safety for a South Carolina public entity, the citation is not the deterrent — the funeral is. A written, 70E-based electrical safety program for your water plants, lift stations, school maintenance shops, and facilities crews is the layer that actually prevents the event, and it's what SC OSHA will measure you against afterward.

06How the 2027 edition lands in South Carolina

Every change in the 2027 Implementation Guide applies here, but four hit South Carolina employers with particular force:

  • The additional-person requirement multiplies across the state's 24/7 automotive and tire plants, lone traveling service technicians (see the Spartanburg case), and remote solar sites. Staffing plans, not just permits, have to change.
  • Host/contract employer coordination — automotive expansions, aerospace support contracts, port work, and data center builds all run on contractors, and two of the five fatalities above happened to workers at someone else's site. The 2027 edition tightens the documentation duty: if you can't produce the two-way hazard information exchange in writing, you don't have one.
  • The new solar article (380) — utility-scale solar is spreading across the state's rural counties and rooftop systems across its warehouses, putting more South Carolina workers under PV-specific requirements every year.

  • Map jurisdiction site by site: SC OSHA for general industry and construction, federal OSHA for maritime work at the port, DOE rules at Savannah River — and 1910.269 for any utility-side work
  • Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
  • Separate "licensed contractor" from "70E qualified person" — with no statewide electrician license, your task-specific qualification records are the only evidence of competence that exists
  • Extend awareness-level training to non-electrical workers: tree and landscaping crews, logging and agricultural equipment operators, service techs, and anyone working elevated equipment near overhead lines — that's who died here
  • Deliver training in the language your crews actually speak — Spanish-language delivery capability is a program requirement, not an accommodation
  • Audit host/contract employer documentation everywhere contractors touch electrical equipment — two-way, in writing, including customer sites your own technicians visit
  • Model the additional-person requirement against actual shift rosters, lone-technician dispatch, and remote sites before the 2027 adoption date
  • Public entities: you are covered by SC OSHA — but size your program to the hazard, not to the penalty levels
