NFPA 70E Compliance in South Dakota
Who enforces electrical safety in South Dakota, what OSHA actually cites here, what happened in real South Dakota electrocution and arc flash cases, what your electricians' licenses require — and how the 2027 edition lands in a state built on meatpacking, agriculture, wind power, and rural electric cooperatives with enormous territories.
01Who enforces electrical safety in South Dakota
South Dakota is a federal OSHA state for private-sector workplaces — there is no South Dakota state OSHA plan. Workplace electrical safety is enforced directly by federal OSHA, applying 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices.
The entire state is covered by one federal OSHA area office — Sioux Falls — under Region 8 (Denver). One office, roughly 77,000 square miles. That geography shapes enforcement in a way employers should understand: routine programmed inspections are thin on the ground west of the Missouri River, and most OSHA activity in South Dakota is driven by fatalities, hospitalizations, amputations, and complaints. If OSHA is standing in your facility, something has usually already gone wrong — which means the citation will be written against the condition of your program on the day of the incident, not the program you intended to build.
Three consequences of the federal-OSHA arrangement that South Dakota employers routinely get wrong:
- "70E isn't law" doesn't protect you. OSHA cites the electrical work practice standards in Subpart S and uses NFPA 70E as evidence of what a reasonable employer would have done — both for specific standards and under the General Duty Clause (Section 5(a)(1)). Every one of the South Dakota cases below was cited under OSHA standards, and in every one the gap between the employer's practice and 70E is the citation narrative.
- Public-sector workers have no OSHA coverage at all. Because South Dakota has no state plan, employees of South Dakota cities, counties, school districts, townships, and state agencies are not covered by OSHA. A municipal electric department lineman in one of the state's 30-plus city-owned utilities, a school district maintenance electrician, a state facilities worker — none of them has an enforceable federal electrical safety standard behind them. A written, 70E-based electrical safety program is the only layer of protection those workers get.
- Low inspection odds are not low consequence. Distance may keep OSHA out of your plant for years, but a single fatality brings the Sioux Falls office, penalty maximums that now exceed $16,000 per serious violation, and — for employers with multiple sites — repeat-violation multipliers that follow the company, not the location. The Cherry-Todd case below started as one lineman's contact and ended as ten cited violations.
02South Dakota by the numbers
South Dakota's headline numbers look small next to Texas or California — until you divide by the workforce. At 5.8 fatal injuries per 100,000 full-time workers in 2024, South Dakota runs well above the national rate, and the reasons are structural: agriculture, construction, and transportation dominate the fatality count, and construction (9 deaths) and agriculture (8) together accounted for more than half of the state's 2024 total. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) carry electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).
Two more national findings that should shape a South Dakota program:
- 70% of workplace electrical fatalities happen to non-electrical workers — farm hands, grain elevator crews, equipment operators, maintenance generalists, grounds crews. In a state where the deadliest electrical scenario is a grain auger, an irrigation pipe, or a boom truck meeting an overhead line, the people at risk are almost never the people who got the electrical training.
- Overhead power line contact is the single largest killer — 49% of all U.S. workplace electrical fatalities. South Dakota's working landscape is a grid of rural distribution lines strung over field approaches, bin sites, and section roads. Every seasonal workforce surge — planting, harvest, construction season — puts untrained people and tall equipment under those lines.
BLS publishes South Dakota fatality counts by major event category; the "exposure to harmful substances or environments" category (5 South Dakota deaths in 2024) includes electricity along with heat, drugs, and chemical exposures. State-level electrocution counts are compiled from CFOI microdata and are suppressed in small-count years. 03Real South Dakota cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real South Dakota incidents, drawn directly from OSHA's investigation and enforcement records for the Sioux Falls Area Office. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. In a small state, these aren't statistics — they're the plants and co-ops your people know.
Production worker electrocuted on a hot wire foam cutter — Benchmark Foam, Inc.
A 29-year-old production laborer at Benchmark Foam's Watertown plant died on May 20, 2016 after contacting exposed energized connections on the hand paddle of a hot wire cutter. Foam had expanded out of a prematurely opened mold; while he was cutting it away, he contacted the un-insulated connections, was electrocuted, and fell to a lower level. OSHA's investigation found the cutter's paddle — a wooden hand tool the crew used every shift — carried exposed live connections, and cited the company under 1910.303's electrical installation requirements (serious violations; $17,460 initial penalty, settled at $12,471).
this worker wasn't doing "electrical work" — he was doing production work with an electrically unsafe tool. That's Article 110's employer duties (an electrical safety program that covers equipment condition, not just electricians) and Chapter 2's maintenance requirements: "normal operation" is only presumed safe when equipment is properly installed, properly maintained, and has no exposed energized parts. A five-minute equipment condition check on that paddle is the difference between a work order and a fatality investigation.

Arc flash on opening an energized high-voltage enclosure — M.J. Electric, LLC
On the morning of June 22, 2017, a 44-year-old power line worker employed by utility contractor M.J. Electric opened an energized high-voltage electrical box at a Sioux Falls work site on East 60th Street North. An arc flash occurred, and he was burned in the flash and fire — severe burns to his face, ear, neck, shoulder, armpit, and arm — and was hospitalized. OSHA opened an inspection within days of the incident. opening an enclosure on energized equipment is precisely the kind of interaction that changes arc flash likelihood — the situation 130.5's risk assessment exists to catch before the covers come off. Add 130.7: PPE selected for the incident energy at the point of work, worn before the door opens, not after. And 120: if the task didn't require the box to be energized, an electrically safe work condition was the compliant plan. The burn pattern in this case — face, neck, arm — is what an arc flash does to whatever isn't rated.

Co-op lineman contacts 14.4 kV conductor from a bucket — Cherry-Todd Electric Cooperative
At about 10 p.m. on September 9, 2017, a 34-year-old lineman for Cherry-Todd Electric Cooperative was working from a bucket truck near Mission, relocating energized 14.4 kV conductors to prepare for a new pole set. He contacted a conductor and sustained shock and burns requiring hospitalization. OSHA's inspection produced ten serious violations — under 1910.269 (electric power generation, transmission, and distribution) and the PPE standards for eye, head, and hand protection (1910.133, .135, .138) — with $44,350 in initial penalties, settled informally at $30,000.
line work at 14.4 kV falls under 1910.269 rather than 70E's core scope — but the failure pattern is identical to what 130.4 and 130.7 exist to prevent: energized work at night, minimum approach distances, insulating protective equipment actually worn. Note the setting: a rural cooperative whose territory spans some of the emptiest country in the lower 48, where the nearest second qualified worker may be an hour away. The 2027 edition's additional-person requirement is aimed at exactly this staffing math — and for co-ops whose crews also touch substations, shop wiring, and metering on the premises side of the service point, your program has to say which rule set governs which task.

The pattern across all three: not one of these was an exotic failure. A production tool with exposed live connections that everybody used anyway. A high-voltage enclosure opened energized. A night-shift line job one contact away from a fatality. In a state with one OSHA office and a lot of lone workers, the program you write and drill is the enforcement layer — OSHA arrives afterward, to document which parts of it didn't exist.
04South Dakota Electrical Commission licensing and what it requires
South Dakota licenses electricians statewide through the South Dakota Electrical Commission, a self-supporting unit of the Department of Labor & Regulation that licenses electricians, inspects wiring installations, and investigates complaints. The main classifications are electrical contractor, Class B electrician, journeyman electrician, and registered apprentice NEEDS SME REVIEW confirm the current full classification list (including maintenance electrician) against SDCL 36-16 and Commission rules. Two facts matter for your electrical safety program:

The licensing gap is the single most misunderstood point I encounter in class. A South Dakota journeyman's license certifies competence in installation per the NEC. OSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock hazards, arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. A journeyman card does not make someone a qualified person under 70E, and OSHA has cited employers who assumed it did. That distinction matters even more here, where a large share of day-to-day electrical work is done by maintenance staff at ag processors, elevators, and small plants — people who may hold no license at all and have never been inside a 70E class.
05Industry by industry: where 70E does the work in South Dakota
Meatpacking and food processing (Sioux Falls and the I-29 corridor)
The Smithfield plant in Sioux Falls is one of the largest pork processing operations in the country, and the I-29 corridor has added major dairy processing capacity — cheese and ingredient plants around Lake Norden and Milbank — on the strength of the state's dairy herd growth. Electrically, these plants share a profile: washdown environments where water, corrosion, and 480 V equipment coexist; ammonia refrigeration and large motor loads maintained by lean crews under production pressure; and a multilingual workforce, which makes English-only training a program defect, not an inconvenience. Wet locations move the shock risk assessment (130.4) from a formality to the core of the job plan, and GFCI protection, cord-and-plug inspection, and equipment condition checks — the unglamorous parts of Article 110 — do most of the lifesaving. Agriculture, grain handling, and ethanol (statewide)
South Dakota runs on corn, soybeans, wheat, and cattle — and on the elevators, feed mills, bin sites, and ethanol plants that process them. POET, the nation's largest ethanol producer, is headquartered in Sioux Falls with plants across the eastern half of the state. The electrical risk here comes in two flavors: overhead line contact — augers, grain probes, boom trucks, and irrigation pipe meeting rural distribution lines, the scenario behind 49% of U.S. electrical fatalities — and process electrical work at elevators and ethanol plants, where dusty, classified locations mean an arc is an ignition source, not just a burn hazard. Wind energy and rural electric cooperatives (statewide)

Meanwhile, the state's distribution grid is substantially cooperative territory: member-owned co-ops covering enormous, sparsely populated service areas. Financial services and back-office facilities (Sioux Falls)
Sioux Falls has been a national banking hub since Citibank moved its card operations there in 1981, and the metro hosts major bank campuses, card operations, and the data and network infrastructure behind them. These facilities run the classic critical-power stack — UPS systems, generator paralleling gear, transfer switches, battery rooms — usually maintained by a small in-house team plus service contractors, under uptime expectations that discourage de-energizing anything. Black Hills tourism and the Ellsworth AFB construction wave (Rapid City)
West River's economy is anchored by Black Hills tourism — hotels, attractions, campgrounds, and the seasonal maintenance armies that keep them running — and, right now, by the construction surge around Ellsworth Air Force Base's B-21 beddown, which has pushed contractor activity, housing construction, and utility upgrades across the Rapid City area. Tourism infrastructure means aging electrical systems worked on by generalist maintenance staff at the exact moment of peak season pressure; a construction boom means temporary power, crane and boom operations near overhead lines, and out-of-state crews unfamiliar with local utility coordination. Both populations are dominated by non-electrical workers — the 70% who die from electricity without ever being in the training matrix.
Public sector (cities, counties, school districts, state agencies)
As covered in Section 1: no OSHA coverage, no state plan, no enforcement backstop. That includes the municipal electric utilities that serve dozens of South Dakota communities — their line and meter crews work the same voltages as co-op and investor-owned crews, with no federal standard behind them. South Dakota public entities that adopt NFPA 70E by policy give their electricians and maintenance staff the same protection private-sector workers get; those that don't leave the gap entirely open. 06How the 2027 edition lands in South Dakota
Every change in the 2027 Implementation Guide applies here, but four hit South Dakota employers with particular force:
- The additional-person requirement lands harder in South Dakota than almost anywhere: lone co-op linemen, single-tech wind sites, one-electrician night shifts at processing plants, and solo maintenance staff at West River tourism properties. If an energized work permit specifies PPE, plan for a second qualified person — which for many rural employers means rescheduling the work, sharing crews, or de-energizing. Decide now, not at 10 p.m. in a bucket.
- Host/contract employer coordination — the Ellsworth construction wave, plant turnarounds, and service contractors in bank and data facilities all run on contracted crews. The 2027 edition tightens the documentation duty: if you can't produce the two-way hazard information exchange in writing, you don't have one.

07South Dakota employer compliance checklist
- Confirm your reporting path to the OSHA Sioux Falls Area Office (Region 8), and whether any of your operations touch 1910.269 utility work — co-ops and municipals especially
- Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
- Separate "Electrical Commission licensed" from "70E qualified" in your training matrix — verify every worker who interacts with energized equipment has documented, task-specific qualification
- Extend awareness-level training to non-electrical workers: elevator and bin crews, seasonal ag hires, equipment operators, hotel and attraction maintenance staff, and anyone moving tall equipment near overhead lines
- Deliver training in the languages your crews actually speak — in Sioux Falls processing plants that can mean several — and verify comprehension, not just attendance
- Model the additional-person requirement against your actual rosters: lone linemen, single-tech wind sites, and one-electrician shifts need a plan before the 2027 adoption date
