01Who enforces electrical safety in Tennessee
Tennessee is a state-plan state. Workplace safety is enforced by TOSHA — the Tennessee Occupational Safety and Health Administration, a division of the Tennessee Department of Labor and Workforce Development. The plan has operated since 1973 and received final certification in 1978. TOSHA adopts the federal standards — 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — and layers its own state-specific general industry rules on top, including a Tennessee-specific standard addressing electrical hazards. TOSHA operates from a central office in Nashville with field offices in Memphis, Jackson, Chattanooga, Knoxville, and Gray (covering the Tri-Cities). Each office runs separate safety, health, and public-sector enforcement units — that last one matters, as you'll see below.
Three consequences of the TOSHA arrangement that Tennessee employers routinely get wrong:
- "70E isn't law" doesn't protect you here either. TOSHA cites the electrical work practice standards and uses NFPA 70E as evidence of what a reasonable employer would have done. Every case in Section 3 below was investigated and cited by TOSHA under exactly the standards 70E operationalizes — training, safe work practices, test instruments, PPE. When your program doesn't hold up against 70E, that gap becomes the citation narrative.
- Public-sector workers ARE covered in Tennessee. Unlike federal-OSHA states such as Texas or Florida, TOSHA's jurisdiction includes state and local government — cities, counties, school districts, municipal utilities, and state agencies. TOSHA maintains dedicated public-sector enforcement units in each of its offices. If you run EHS for a Tennessee public entity, you are inspectable and citable, and your electrical safety program will be judged the same way a private plant's is.
- Federal enclaves flip you back to federal OSHA. TOSHA's plan does not cover federal workplaces — and in Tennessee that includes Tennessee Valley Authority facilities and military installations, along with maritime employment and USPS operations. A contractor crew that works Monday at a TVA plant and Tuesday at a municipal substation answers to two different enforcement agencies in the same week. Your program has to work under both, which in practice means building it to the stricter reading.
02Tennessee by the numbers
Tennessee's industry mix concentrates electrical risk: automotive and appliance manufacturing plants full of aging 480V distribution, one of the nation's largest chemical complexes, a massive logistics sector, and a power system that reaches every county. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) carry electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).
Two more national findings that should shape a Tennessee program:
- 70% of workplace electrical fatalities happen to non-electrical workers — laborers, roofers, HVAC mechanics, machine operators, grounds crews. Look at the Tennessee cases below: an HVAC technician, a machinery maintenance worker, roofing crews, construction laborers rigging trusses. Not one victim was a licensed electrician doing electrician work. If your 70E training only reaches your electricians, it's missing the people who actually die.
- Hispanic and Latino workers carry a disproportionate share of electrical fatalities (0.18 per 100,000 vs. 0.10 for white non-Hispanic workers, per ESFI). Tennessee's construction and roofing workforce includes large Spanish-speaking crews, especially in the Nashville building boom. If your training isn't delivered effectively in Spanish, it isn't delivered.
BLS publishes Tennessee fatality counts by major event category; the "exposure to harmful substances or environments" category (16 Tennessee deaths in 2024) includes electricity along with heat and overdose deaths — 14 of the 16 were overdoses. 03Real Tennessee cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real, recent Tennessee incidents, drawn directly from TOSHA fatality investigation records in OSHA's enforcement database. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.
Maintenance worker electrocuted while troubleshooting a production line with a multimeter — Lochinvar LLC
A 31-year-old employee at the Lochinvar water heater plant in Lebanon was troubleshooting electrical equipment on a production line at about 7:45 p.m. when the multimeter he was using contacted an energized component, and he was electrocuted. TOSHA cited the company under exactly the standards a 70E program exists to satisfy: 1910.333(c)(2) (work on or near exposed energized parts), 1910.335(a)(1) (electrical PPE), and 1910.334(c) (test instruments and their use), with a training citation issued and later deleted. Initial penalties totaled $13,500, resolved by informal settlement.
diagnostic work on energized equipment is energized work. Article 110.6 governs test instrument ratings, condition, and use; 130.4 and 130.5 require shock and arc flash risk assessments before the meter ever comes out; 130.7 puts rated gloves and PPE on the person holding it. An evening-shift troubleshooting task with a multimeter is the single most common energized task in manufacturing — and the citation list here reads like the table of contents of Article 130.

Maintenance worker electrocuted by an energized conveyor frame — Lasco Fittings
A 30-year-old machinery maintenance employee at the Lasco Fittings PVC plant in Brownsville was troubleshooting an injection molding machine. Reaching to close a cooling water valve, he contacted the metal frame of a parts conveyor and was fatally shocked. The investigation found a 480-volt conductor had been pinched between a controller body and its metal mounting hardware, energizing the conveyor frame to 140–170 volts AC. TOSHA issued three serious citations under 1910.303(b) — the installation and maintenance provisions — totaling $8,575.
this is Chapter 2 of 70E — maintenance — doing the quiet work most programs skip. A damaged conductor energized exposed metal for however long that pinch went unfound, and the person it killed wasn't even performing electrical work. Condition of maintenance feeds directly into every risk assessment under 130.4 and 130.5: equipment that isn't maintained can't be trusted to behave like the single-line says it will. Test-before-touch (Article 120's verification discipline) applies to "dead" metal too.

HVAC technician electrocuted by energized ductwork in a residential attic — Hiller LLC
A 47-year-old HVAC technician for Hiller, one of Middle Tennessee's largest home services companies, was troubleshooting an air conditioning unit in the attic of a Springfield-area residence. He was working alone. The homeowner later found him lying face down near the ductwork; a responding officer's tester confirmed the duct work itself was carrying electric current. TOSHA opened a fatality investigation the same day.
an HVAC mechanic is exactly the "non-electrical worker" who accounts for 70% of electrical fatalities nationally. Article 110.4's training requirement scales to the hazard, not the job title — a technician who troubleshoots powered equipment needs qualified-person-level training for those tasks, a tested meter, and the habit of treating conductive surfaces as energized until verified. And a service-company dispatch model that sends technicians into attics alone needs to answer the 2027 edition's job safety planning and additional-person questions before the work order goes out.
Subcontractor electrocuted when a laddervator falls into a 14.4kV line — Austermiller Inc. roofing project
On a residential roofing project run by Mount Juliet-based contractor Austermiller Inc., a 36-year-old subcontracted worker was dismantling a laddervator (a ladder hoist) as the job wrapped up. He lost control of the equipment and it fell into a 14.4kV power line. He was electrocuted; two coworkers who tried to help were hospitalized with severe electrical shocks. TOSHA cited three serious violations — two under 1926.416(a), the construction electrical protection rules — with penalties settling at $8,000.
Article 130.9 puts hard approach boundaries around overhead lines for exactly this reason — handling long conductive equipment near distribution voltage is a fatality mechanism, not a variance. And note who died: a subcontractor. Article 110.5's host and contract employer duties — the information exchange the 2027 edition tightens further — are what put the power line on the pre-job briefing before anyone extends a ladder hoist under it. Overhead contact is 49% of all U.S. electrical fatalities, and almost none of the victims are electricians.

Two workers electrocuted in separate crane-rigging incidents on the same day
On October 3, 2023, TOSHA's Chattanooga office opened two separate fatality investigations for the same failure mode on the same day. At one new-home site, a 40-year-old laborer rigging wooden trusses was holding the crane's wire rope when it contacted overhead power lines. At another, a 51-year-old laborer rigging porch joists was killed when the crane's load line contacted a 14.4kV line. Two different employers, two different sites, one identical mechanism: a crane line, an overhead conductor, and a worker completing the circuit through the rigging.
130.9's overhead line boundaries and the pre-job briefing exist to force one question before the boom swings: where is the line, and what is our clearance? Neither victim was an electrical worker; both were inside the circuit the moment the rigging touched the conductor. If your crews lift anything near distribution lines — trusses, joists, shingles, HVAC units — your electrical safety program owns that lift plan, and "the crane operator watches for wires" is not a plan.

The pattern across all five: not one of these was an exotic failure. A meter on a live component. A pinched conductor nobody found. A technician alone in an attic. A ladder hoist and two crane lines under distribution wires. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments. And notice the penalty amounts: TOSHA fatality cases here settled for $8,000–$13,500. The citation is not the cost that should scare you. The incident is.
04Tennessee licensing and what it actually covers
Tennessee's electrical licensing structure confuses even people who work in it, because it splits three ways. At the state level, the Board for Licensing Contractors (Tennessee Department of Commerce & Insurance, under T.C.A. Title 62, Chapter 6) licenses electrical contractors — projects of $25,000 and up require a contractor's license with the electrical classification. Below that threshold, the same board issues the Limited Licensed Electrician (LLE) credential, required for electrical work under $25,000 per project in jurisdictions where the State Fire Marshal's Office (Division of Fire Prevention) issues permits and performs inspections. And individual journeyman-level licensing is local: Tennessee has no statewide journeyman card, so cities and counties that run their own codes enforcement issue their own electrician licenses with their own exams and renewal rules. The licensing gap is the single most misunderstood point I encounter in Tennessee classes. An LLE credential or a local journeyman card certifies installation competence against the NEC. TOSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock and arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. 05Industry by industry: where 70E does the work in Tennessee
Automotive manufacturing (Smyrna, Spring Hill, Chattanooga, Stanton)
Tennessee's auto corridor is enormous: Nissan's Smyrna assembly plant is among the largest in North America, GM builds at Spring Hill, Volkswagen assembles in Chattanooga, and Ford's BlueOval City campus in Stanton is bringing electric truck and battery production to West Tennessee at megasite scale. Electrically, these plants share a profile — dense 480V distribution, robotic lines where troubleshooting pressure is constant, battery and EV systems adding dc hazards (Article 310 and Article 360 territory), and a deep tier-supplier ecosystem where the safety program maturity drops off fast below tier one. The Lochinvar and Lasco cases above are manufacturing-floor deaths from routine troubleshooting; scale that task profile up to an assembly plant and the exposure count multiplies accordingly. Chemicals, aluminum, and appliances (Kingsport, Alcoa/Blount County, Cleveland)
East Tennessee runs heavy industry at a scale most people don't associate with the state. Eastman's Kingsport complex is one of the largest integrated chemical manufacturing sites in North America, with its own on-site power generation — classified locations where an arc is an ignition source, medium-voltage distribution, and turnaround-driven contractor surges. The aluminum industry that named the city of Alcoa still rolls metal in Blount County, and Whirlpool's Cleveland operation anchors appliance manufacturing in the southeast corner. These sites carry the highest incident-energy equipment in the state outside the utility system, which makes arc flash risk assessment (130.5), maintenance of protective devices (Chapter 2), and the 2027 hand protection changes immediate, budgetable issues. TVA and the power system — a jurisdictional puzzle
Almost every electron in Tennessee moves through the Tennessee Valley Authority, a federal utility — and that makes electrical safety jurisdiction here genuinely three-layered. TVA's own facilities are excluded from TOSHA's plan: TVA generation plants and switchyards sit under federal jurisdiction, not state. The roughly 150 local power companies that distribute TVA power — municipal utilities like Nashville Electric Service, Memphis Light, Gas and Water, EPB in Chattanooga, and dozens of cooperatives — are Tennessee employers under TOSHA, with the municipals covered through TOSHA's public-sector units. Memphis became a national data center story almost overnight when xAI stood up its Colossus supercomputer campus there, and Clarksville and the Nashville region are drawing hyperscale builds behind it — all of it arriving in a market where the critical-facilities electrical workforce is still thin. The failure mode to study is inspection and testing work on UPS and distribution gear under uptime pressure, performed by contractors, on equipment nobody wants to de-energize. Memphis is also home to FedEx's global air hub — the logistics buildings that surround it run miles of conveyors and sortation equipment maintained on unforgiving overnight windows, which is precisely the lean-night-shift scenario the 2027 additional-person requirement stresses. Healthcare (Nashville)
Nashville is the healthcare-industry capital of the country — HCA and a dense cluster of hospital operators are headquartered there, and the hospitals themselves are 24/7 facilities where "just schedule an outage" collides with patient care. The opposite of the Texas story: Tennessee's public employers are fully inside TOSHA's jurisdiction, inspected by dedicated public-sector units in every TOSHA office. A school district maintenance electrician, a county courthouse facilities crew, a municipal water plant operator — all covered, all citable. That's leverage: if you administer safety for a Tennessee public entity, a written 70E-based electrical safety program isn't just good practice, it's what TOSHA's public-sector compliance officers will ask to see after an incident. 06How the 2027 edition lands in Tennessee
Every change in the 2027 Implementation Guide applies here, but four hit Tennessee employers with particular force:

07Tennessee employer compliance checklist
- Confirm which TOSHA office covers each of your Tennessee sites — and whether any of your work happens on federal ground (TVA facilities, military installations), where federal OSHA takes over
