NFPA 70E Compliance in Vermont
Who enforces electrical safety in Vermont, what VOSHA actually cites here, what happened in real Vermont electrocution and shock cases, what your electricians' licenses require — and how the 2027 edition lands in a state built on one giant semiconductor fab, a thousand dairy farms, ski mountains, and the most solar-dense grid in the Northeast.
01Who enforces electrical safety in Vermont
Vermont is a full state-plan state. Workplace safety is enforced by VOSHA — the Vermont Occupational Safety and Health Administration, a division of the Vermont Department of Labor headquartered in Montpelier. The plan has been in place since 1973 (certified 1977), and it covers both private-sector employers and state and local government workers — cities, towns, school districts, municipal utilities, and state agencies are all inside enforcement. Only federal employees, the Postal Service, and certain maritime operations remain under federal OSHA.
VOSHA adopts the federal OSHA standards by reference, so the electrical rulebook looks familiar: 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices. But Vermont maintains state-specific standards beyond the federal set, including its own permissible exposure limits and — notably for this page — a Vermont lineworker safety standard, one of very few state-level rules in the country aimed squarely at electric utility line work.
Three consequences of the VOSHA arrangement that Vermont employers routinely get wrong:
- "70E isn't law" doesn't protect you here either. VOSHA cites the adopted electrical work practice standards and uses NFPA 70E as evidence of what a reasonable employer would have done. Every case in Section 3 below was cited under exactly the requirements 70E teaches you to execute: de-energize first, verify, train, protect. When your program doesn't hold up against 70E after an incident, that gap becomes the citation narrative.
- Public-sector workers ARE covered — the opposite of Texas and the other federal-OSHA states. A municipal electric department lineworker in Hardwick, a school district maintenance electrician in Rutland, a state facilities crew in Waterbury — all have enforceable VOSHA standards behind them, and their employers face the same citations a private plant does. If you run safety for a Vermont town, district, or agency, VOSHA can and does inspect you.
- Small state, real enforcement — and settlements that still cost. VOSHA runs a small inspectorate out of Montpelier, and most of the cases below resolved by informal settlement at reduced penalties. 02Vermont by the numbers
Vermont's totals are small — that's the smallest workforce in the country outside Wyoming — but the mix should worry you: construction alone carried 38% of the state's 2023 fatalities, and construction is one of the two industries with electrical fatality rates roughly seven times the all-occupation average. Nationally, utilities run 0.75 electrical deaths per 100,000 workers and construction 0.73, against 0.11 for all occupations — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).
Two more national findings that should shape a Vermont program:
- 70% of workplace electrical fatalities happen to non-electrical workers — laborers, roofers, truck drivers, farm workers, grounds crews. Vermont's own recent record proves the point: the state's most recent electrocution death was a construction laborer moving a ladder, and its worst overhead-line injury was a vac-truck driver. If your 70E training only reaches your electricians, it's missing most of the people who die from electricity.
- Small crews mean lone workers. Vermont's economy runs on two-person shops, single-electrician creameries, and solo technicians driving between remote sites. The 2027 edition's additional-person requirement (Section 6) is going to collide with that staffing reality harder here than almost anywhere.
With counts this small, single-year electrical fatality figures for Vermont are statistically noisy — BLS suppresses most sub-category detail, and an electrocution that involves a fall (like the 2023 case below) can be classified under a different event category. 03Real Vermont cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real Vermont incidents, drawn directly from VOSHA's investigation summaries and inspection records in OSHA's enforcement database. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. In a state this small, these aren't statistics — they're your neighbors' job sites.
Roofing laborer electrocuted moving an aluminum ladder into a power line — C&V Contracting
A 24-year-old construction laborer was working near the roof peak of a two-story multi-family building, lifting an aluminum roof hook ladder to set it on the opposite slope. Moving the ladder, he came within the approach distance of the single-phase overhead distribution line running past the building. He was electrocuted and fell roughly 35 feet to the ground. VOSHA cited the roofing contractor for four serious violations — including overhead line clearance and ladder-use requirements under 1926 — with an initial penalty of $18,082, settled at $12,500.
this is 130.9 — work near overhead lines and the approach boundaries that apply to everyone, not just electricians — plus 110.4's training obligation for the workers your program probably doesn't consider "electrical." A roofer with an aluminum ladder is exactly who the 49% overhead-line statistic describes. The job briefing that the 2027 edition's planning emphasis demands takes ninety seconds: where is the line, what is the equipment, who stays how far away.

Technician burned on an energized extruder heating band — Mylan Technologies
At the Mylan Technologies pharmaceutical plant on Lake Street (a Viatris company — one of Franklin County's largest manufacturing employers), a 59-year-old electrical technician was standing on an elevated platform above an extruder line, feeding a thermocouple cable down to a coworker. He lost his balance, and his right hand landed on the energized electrical terminals of a cylinder heating band. Third-degree electrical burns; hospitalization. VOSHA's citations tell the story plainly: lockout/tagout failures under 1910.147 and energized work practice violations under 1910.333 — $27,306 in initial penalties, settled at $13,653.
Article 120 — the equipment wasn't put into an electrically safe work condition before someone worked above and around it — and 130.4's shock risk assessment, which exists to answer the question nobody asked: what happens if a hand ends up where hands end up when people lose balance? Exposed energized terminals within reach of a work platform is a condition, not an accident. This is what a maintenance-task risk assessment is for.

Electrician burned pulling live 480V wires from a fuse panel — New England Air Systems
An electrician for a Williston mechanical contractor was reversing a fan's rotation and chose to do it live: he pulled two energized 480-volt conductors from a fuse panel, and while he reached for his wire strippers, the two loose live wires touched. The resulting fault burned his hand. VOSHA cited three serious violations with an initial penalty of $34,699 (settled at $20,800) — including 1910.333(a), the requirement that live parts be de-energized before work unless the employer can show infeasibility, plus lockout and PPE items under 1910.333 and 1910.335.
130.2 exists for exactly this moment. "It's faster live" is not one of the permitted justifications for energized work — and a fan reversal is about as far from infeasible-to-de-energize as a task gets. Had this gone through 130.3's energized work permit process, someone would have had to sign their name to the claim that swapping two motor leads couldn't wait for an ESWC. Nobody signs that. The permit isn't paperwork; it's the mechanism that forces the de-energize decision.

Vac-truck boom contacts a 7,200-volt line at a pump station — Wind River Environmental
A 62-year-old driver was raising the boom on a Vactor truck to pull sludge from a pump station vault when the boom struck a 7,200-volt conductor on a three-phase distribution line. Current entered through his left hand and exited through both feet. He survived, hospitalized with electrical burns. VOSHA's two serious citations are the most instructive part: 1910.332 — the training standard — because a truck driver working a boom near distribution lines had never been trained on electrical hazards, and 1910.333(c) for the work practices around overhead lines. Initial penalties of $22,732, settled at $13,639.
the citation VOSHA led with was about training, and that's the lesson: 110.4 and 130.9 reach every worker who operates elevated equipment near overhead conductors — vac trucks, dump bodies, cranes, bucket trucks, grain augers. In rural Vermont, where distribution lines run tight along every road and farm lane, "who on this crew has had overhead-line awareness training" is a question your program has to answer for drivers and operators, not just electricians.

Electrician shocked on an energized lighting circuit — Interstate Electrical Services
At 6:20 a.m., a 50-year-old electrician on a Rutland project was removing the cover from a 4-inch junction box on an energized lighting circuit when he took a shock, slumped over the top of his ladder, and aspirated vomit — hospitalized. VOSHA initially cited two serious violations under 1926.416 and 1926.417 (protection from energized circuits, and lockout/tagging of circuits) at $26,520; both citations were deleted in an informal settlement. The enforcement record ended at zero. The man's injuries didn't.
"it's just a lighting circuit" has put more electricians on ladders into energized work than any phrase in the trade. 120.6's verification sequence — test every conductor, every time, before contact — doesn't have a lighting exception, and 130.2 doesn't either. Note the other lesson: a deleted citation is not vindication. Settlements make penalties disappear; they don't make a program compliant, and they won't matter to the next worker on the next junction box. Build the program for the worker, not the citation.

The pattern across all five: not one of these was an exotic failure. A ladder moved two feet too far. A hand where hands go when balance goes. Two live wires that touched while someone reached for strippers. A boom raised without looking up. A junction box "everyone knew" was just lighting. The 2027 edition's changes — job safety planning, the additional-person requirement, tightened host/contractor duties — are aimed at exactly these ordinary moments.
04Vermont licensing and what it requires
Vermont licenses electricians at the state level through the Division of Fire Safety (Department of Public Safety), under rules set by the state's Electricians' Licensing Board — with master (EM), journeyman (EJ), and specialty electrician (ES) classifications, and apprentice registration under supervision. Two facts matter for your electrical safety program:

The licensing gap is the single most misunderstood point I encounter in New England classes. A Vermont master's license certifies competence in installation per the NEC. VOSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock hazards, arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. Look back at the Rutland and Williston cases in Section 3: both injured workers were electricians. The license didn't stop either incident, because the license was never designed to.
05Industry by industry: where 70E does the work in Vermont
Semiconductors (Essex Junction)
GlobalFoundries' Essex Junction fab — the former IBM Burlington plant — is the largest private employer in Vermont, and electrically it is a different planet from the rest of the state: medium-voltage distribution, massive UPS and rectifier plants, tool-install work running continuously, and a deep bench of contract trades working around equipment that cannot tolerate an unplanned outage. That combination — uptime pressure, contractors, and energized diagnostic work — is precisely the failure mode in the national case record. Host/contract employer coordination under 110.5 carries most of the compliance weight on a site like this, and the 2027 edition tightens the documentation duty: the hazard information exchange has to exist two-way, in writing, per task — not as a badge-in orientation video. Dairy farms and food processing (statewide)
Vermont's signature industries run on some of the state's worst electrical infrastructure: barn wiring installed generations ago, corroded by ammonia and moisture; wet concrete floors that make every fault a grounding path through a person or a herd; stray voltage chronic enough that Vermont utilities run dedicated farm testing programs; and grain, feed, and manure-handling equipment that moves under and near farmyard distribution lines. On the processing side — creameries, cheese plants, bottling lines, sugarhouses running high-current reverse-osmosis and evaporator systems every March — the St. Albans extruder case in Section 3 is the template: energized terminals, wet environments, one maintenance person, no ESWC. Ski areas (Green Mountains, statewide)
A Vermont ski resort is an industrial electrical plant wearing a hospitality badge: lift drive motors and control systems strung up a mountain, snowmaking compressor and pump plants pushing thousands of horsepower on winter nights, and miles of buried and overhead feeders crossing terrain that's iced, remote, and dark exactly when the work happens. The operational reality is the hazard: snowmaking and lift maintenance run overnight, in weather, on lean crews, under open-for-business deadline pressure — the precise conditions where "we'll troubleshoot it live and reset it" becomes culture. The 2027 additional-person requirement lands hard here: a lone electrician at a mid-mountain pump house on an energized task is no longer a compliant plan, and staffing the second person has to be decided in the fall hiring plan, not at 2 a.m. in January.
Utilities, line work, and small hydro (statewide)
Vermont's grid is rural, radial, and buried in trees — and every major storm proves it, with Green Mountain Power and the state's municipal and cooperative utilities running multi-day restorations across mountain terrain. Line work sits under 1910.269 and Vermont's own state lineworker safety standard rather than 70E's core scope, but the jurisdictional seam is where programs fail: utility crews, contractors, and municipal electric departments all touch both sides of the service point, and storm-response mutual aid brings out-of-state crews under Vermont rules. Add the state's fleet of small hydro stations — century-old powerhouses with vintage switchgear and skeleton staffing — and the seam questions multiply. Solar and storage (statewide)
Vermont has among the highest per-capita solar adoption in the country — thousands of net-metered arrays, community solar fields in former pastures, and a growing layer of battery storage, much of it installed and serviced by small local contractors. The 2027 edition speaks directly to this sector: the new dedicated solar article (380) puts PV-specific requirements on the map, Article 360 covers the batteries being hung beside them, and dc hazards under Article 310 don't switch off when the inverter does. Public sector (towns, districts, state agencies, municipal utilities)
Here Vermont diverges completely from the federal-OSHA states: public employees are covered. VOSHA inspects town highway garages, school districts, water and wastewater plants, state facilities, and the fourteen municipal electric utilities the same way it inspects a private plant — with the same standards and the same citations. That's a compliance obligation, but it's also leverage: a Vermont public entity that adopts a written, 70E-based electrical safety program isn't doing something voluntary and unenforceable, it's meeting a live legal duty. 06How the 2027 edition lands in Vermont
Every change in the 2027 Implementation Guide applies here, but four hit Vermont employers with particular force:

07Vermont employer compliance checklist
