NFPA 70E Compliance in Virginia
Who enforces electrical safety in Virginia, which state-unique standards go beyond federal OSHA, what happened in real Virginia electrocution cases, what your electricians' DPOR licenses actually cover — and how the 2027 edition lands in Data Center Alley, the shipyards, and the rest of the Commonwealth's economy.
01Who enforces electrical safety in Virginia
Virginia is a full state-plan state. The Virginia Occupational Safety and Health program (VOSH), run by the Department of Labor and Industry (DOLI) from its Richmond headquarters, has been enforcing workplace safety since 1976 — covering both the private sector and every state and local government workplace in the Commonwealth. VOSH adopts the federal electrical standards you already know — 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of demonstrating compliant safe work practices.
But Virginia doesn't stop at the federal baseline. VOSH maintains a set of state-unique standards with no federal counterpart, and several of them are squarely electrical: a dedicated Tree Trimming Operations standard (16VAC25-73), telecommunications standards that address approach distances to electrical hazards, a reverse-signal-operation rule — and, above all, the Overhead High Voltage Line Safety Act, a statutory standard that requires advance notification of and coordination with the line's operator before work is performed within ten feet of overhead high-voltage lines. As you'll see in the cases below, VOSH enforces that ten-foot rule aggressively, including with willful classifications that push penalties into six figures.
Three things Virginia employers routinely get wrong about this arrangement:
- "70E isn't law" doesn't protect you. VOSH cites the adopted electrical work practice standards and uses NFPA 70E as evidence of what a reasonable employer would have done — under the specific standards and under the state's general duty provision. When an incident occurs and your program doesn't hold up against 70E, that gap becomes the citation narrative. And in Virginia, the exposure doesn't end at civil penalties: a 2019 tree-trimming electrocution here ended in a criminal prosecution and an involuntary manslaughter conviction (more in Section 3).
- Virginia is a three-jurisdiction state. VOSH does not cover maritime and shipyard employment — Newport News Shipbuilding and the Hampton Roads ship repair industry answer to federal OSHA's maritime standards. Federal military facilities and federal enclaves (of which Virginia has more than almost any state) are federal territory too, and coal mines in the southwest answer to MSHA. If your crews cross those gates — and Virginia's electrical contractors constantly do — your program has to work under multiple rule sets, and your people need to know which one applies where they're standing.
- Public-sector workers ARE covered — which cuts both ways. Unlike federal-OSHA states such as Texas, Virginia's cities, counties, school divisions, and state agencies are inside VOSH's jurisdiction, and VOSH can and does assess penalties against public-sector employers. A municipal electrician in Norfolk has an enforceable standard behind them. If you run EHS for a Virginia public entity, you are subject to inspection like any plant — build the program accordingly.
02Virginia by the numbers
Virginia's fatality rate runs below the national average — 2.7 per 100,000 workers in 2023 — but the electrical exposure profile is anything but mild. Of the 30 fatal accidents VOSH responded to in FFY2024, two involved electrocution or overhead high-voltage lines, and every case on this page is an overhead-line contact. That tracks the national data: the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) carry electrical fatality rates roughly seven times the all-occupation rate of 0.11, and electricians as an occupation sit at 2.89 per 100,000 — twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).
Two more national findings that should shape a Virginia program:
- 70% of workplace electrical fatalities happen to non-electrical workers — laborers, roofers, HVAC mechanics, grounds crews, equipment operators. Every fatality in Section 3 below fits that profile: tree trimmers and roofers, not electricians. If your 70E training only reaches your electricians, it's missing most of the people who die from electricity.
- Hispanic and Latino workers carry a disproportionate share of electrical fatalities (0.18 per 100,000 vs. 0.10 for white non-Hispanic workers, per ESFI). Northern Virginia's construction and data center buildout runs on a heavily immigrant workforce. If your training isn't delivered effectively in Spanish, it isn't delivered.
Virginia fatality counts above come from DOLI's FFY2024 State OSHA Annual Report, which cites BLS CFOI data for calendar 2023 and VOSH's own fatality-response log for FFY2024. 03Real Virginia cases: what the citations say
Abstract risk doesn't change behavior — cases do. These are real Virginia incidents, drawn from VOSH enforcement records and news coverage. Notice the pattern before you read a single one: every case is an overhead power line contact, and almost none of the victims were electricians. That is exactly what the national 49% statistic predicts, and it's why Virginia wrote its own overhead-line and tree trimming standards. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.
Scaffold built seven feet below a 19,900-volt line — worker shocked, half-million-dollar citation
A worker for masonry contractor T.D. Fraley & Sons was hospitalized after contacting an overhead 19,900-volt power line while installing guard rails on a scaffold in Springfield. VOSH's inspection found the scaffold had been erected roughly 87 inches — about seven feet — directly below the energized conductors. The citation stack tells the story: serious violations for scaffold construction, access, guardrails, and training; four willful-serious violations at $127,254 each for working within ten feet of overhead high-voltage lines without the safeguards and utility notification Virginia law requires; and a $5,000 item for failing to report the hospitalization within 24 hours. Total: $528,692 — one of the largest electrical-hazard penalty packages in VOSH history.
this is 130.9 (work near overhead lines) plus the planning duties of 110.3 and Article 105 — the hazard was identified before the first frame went up, or it wasn't identified at all. Virginia's Overhead High Voltage Line Safety Act adds a legal trigger 70E doesn't have: the line's operator must be notified and protective arrangements made before anyone works inside ten feet. A pre-job survey that maps every overhead conductor on site, with boundaries and utility contact built into the plan, is what half a million dollars buys you the cheap way.
Line-clearance tree trimmer electrocuted when wind swung a cut limb into a 19,900-volt conductor
An employee of Lucas Tree Experts was killed during line-clearance tree trimming at a Chesapeake cemetery when a limb he had cut was caught by wind gusts of up to 32 mph and swung into a 19,900-volt power line. VOSH cited the company for inadequate PPE selection, failure to use insulated equipment near energized conductors, performing the work in adverse weather, an unsecured climbing rope, a missing hazard communication program — and a willful-serious violation for failing to maintain minimum approach distances, at $70,000 of the $100,270 total.
line-clearance work sits at the 1910.269/70E seam, but the failures are universal: 130.4's shock risk assessment and approach boundaries, and the job safety planning the 2027 edition doubles down on — which explicitly includes conditions like weather. A 32-mph gust is not an act of God; it's a foreseeable input the plan is required to account for. Virginia's own Tree Trimming Operations standard (16VAC25-73) exists because this exact scenario keeps recurring here.
Tree work near energized lines is also where Virginia showed it will go beyond civil penalties: a May 2019 electrocution of a tree-trimming worker near a 19,900-volt overhead line led to a criminal prosecution and an involuntary manslaughter conviction with a suspended five-year sentence, followed by a civil settlement in 2024, according to DOLI's FFY2024 annual report. Arborist electrocuted when a trimmed branch contacted a live wire
An arborist died in Alexandria's Del Ray neighborhood on September 21, 2024, when a branch of the tree he was trimming made contact with an energized power line. He was found unresponsive in the tree; Dominion Energy responded to de-energize the hazard. Grounds maintenance workers die from electricity at many times the all-occupation rate, and the tree care industry sits in a coverage gap — small employers, often Spanish-speaking crews, rarely reached by formal electrical safety training — that Virginia's dedicated tree trimming standard was written to close.
130.9's approach boundaries for overhead conductors and the definition of a qualified person — which requires demonstrated training on the specific hazard, not a job title or an arborist certification. Two workers killed positioning a ladder into overhead power lines
Two men performing roof work on a house in Bristol died on the morning of July 31, 2025, when the ladder they were positioning made contact with — or came close enough to arc to — energized overhead power lines. Police reported an electrical arc; both workers were electrocuted. They had been working at the property all week. This is the most common electrocution scenario in America — conductive equipment raised into an overhead line by workers who were never anyone's "electrical" population — and it killed two people at once.
130.9 again — approach boundaries and the handling of long conductive objects near overhead lines — plus the reality check behind the 70% statistic: roofers, painters, and gutter crews die from electricity far more often than electricians do. An awareness-level briefing ("look up, map the lines, keep ladders ten feet away") costs fifteen minutes. Every residential and light-commercial contractor in Virginia should treat it as a standing pre-job step, because the Overhead High Voltage Line Safety Act makes the ten-foot zone a legal boundary, not a suggestion.

The pattern across all of these: not one victim was working on electrical equipment. A scaffold, a chainsaw, a ladder. In Virginia, the deadliest electrical hazard is the one sixty feet of air is supposed to protect you from — which is why the state wrote its own overhead-line law, and why your program's reach has to extend far past the electricians.
04DPOR licensing and what it requires
Virginia licenses individual electricians statewide through the Department of Professional and Occupational Regulation (DPOR) — the Board for Contractors' Tradesmen Program, with journeyman and master electrician levels on a two-year renewal cycle. (Electrical contracting firms hold a separate Class A/B/C contractor license from the same board.) Two facts matter for your electrical safety program:

The licensing gap is the single most misunderstood point I encounter in Virginia classes. A DPOR journeyman or master card certifies competence in installation per the NEC. VOSH's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock and arc flash hazards, approach boundaries, PPE selection, and the skills to distinguish live parts and verify de-energization. A master electrician's license does not make someone a qualified person under 70E, and employers have been cited for assuming it did.
05Industry by industry: where 70E does the work in Virginia
Data centers (Loudoun and Prince William — "Data Center Alley")
Northern Virginia is the largest data center market on earth. Loudoun County's Ashburn corridor — Data Center Alley — hosts the densest concentration of data center capacity anywhere, and the buildout is now surging through Prince William County and down the I-95 corridor. Electrically, this industry is defined by exactly the conditions that kill: uptime pressure that makes nobody want to de-energize anything; a contractor-dominated workforce doing inspection, testing, and commissioning on UPS systems, switchgear, and generator paralleling gear; and continuous construction, where the seam between 1926 Subpart K and 1910 Subpart S moves through the building as sections energize. Every energization milestone needs to function as a program milestone — boundaries drawn, signage posted, unqualified trades briefed, permits enforced. And the 2027 additional-person requirement lands harder here than almost anywhere: a lean critical-facilities team executing an energized work permit that specifies PPE now needs a second qualified person present, which means your staffing model — not just your paperwork — has to change before the maintenance window opens. Shipbuilding, ship repair, and the Port of Virginia (Hampton Roads)
Newport News Shipbuilding — the only builder of U.S. nuclear aircraft carriers and Virginia's largest industrial employer — anchors a Hampton Roads maritime economy that includes Norfolk Naval Shipyard, a dense private ship-repair sector, and the Port of Virginia's terminals. Here's the jurisdictional trap: VOSH does not cover maritime and shipyard employment. Federal OSHA's maritime standards apply inside the yards, VOSH applies outside them, and federal enclaves like Naval Station Norfolk are federal territory altogether. Electrical contractors in Hampton Roads routinely cross all three lines in a single week — shore power and 400 Hz systems at the pier, shipboard dc and battery systems, and ordinary premises wiring in the shops. Your program must say which rule set governs which task, and your crews must be able to answer that question in the field, because "the other agency's problem" is not a defense anyone has ever won with. Utilities and offshore wind (Dominion, co-ops, CVOW)
Dominion Energy's Coastal Virginia Offshore Wind project — 176 turbines off Virginia Beach, the largest offshore wind project under construction in the country — is turning Hampton Roads into an offshore-energy hub, with monopile staging at the port and a new specialized marine workforce. Utility transmission and distribution work falls under 1910.269 rather than 70E's core scope, but the boundary between "utility work" and "premises wiring work" is a live question for every co-op, municipal utility, and utility contractor in the state — and storm restoration under time pressure is precisely where procedural shortcuts happen. Offshore work adds the maritime jurisdiction seam on top. If your crews touch both sides of the service point, define which rules apply to which task in writing. Manufacturing (Richmond, Shenandoah Valley, Southside, New River Valley)
Virginia's manufacturing base — food processing in the Valley, heavy truck assembly in the New River Valley, Micron's semiconductor fab in Manassas, chemicals and packaging around Richmond and Hopewell — runs on aging MCCs, lean maintenance staffing, and night shifts: the exact conditions where the 2027 additional-person rule meets its hardest test. A one-electrician night shift cannot lawfully execute an energized work permit that specifies PPE. Your options are re-engineering the task, rescheduling it, or restaffing the shift — and that decision belongs in your program now, not at 2 a.m. in front of a down line. Solar and storage (Southside and rural Virginia)
Utility-scale solar is spreading fast across Southside Virginia's flat, cheap land, with battery storage following behind it — much of it in counties where the nearest coworker might be forty minutes away. The 2027 edition's dedicated solar article (Article 380) and the additional-person requirement change remote-site staffing math: a lone technician on an energized combiner task is no longer a compliant plan, and storage sites add dc and stored-energy hazards (Articles 310 and 360) that LOTO alone doesn't control. Coal and mining (Southwest Virginia)
The coalfield counties of far southwest Virginia add one more jurisdiction: mines answer to MSHA, not VOSH, with their own electrical rules. The seam runs at the prep plant, the load-out, and the shop — facilities where MSHA and VOSH jurisdiction can both plausibly attach depending on function. Contractors serving mines and their surface facilities need a program that survives on either side of that line; 70E's risk-assessment framework is the common language that does.
Public sector (cities, counties, school divisions, state agencies)
The opposite of the Texas story: Virginia's public employers are fully covered by VOSH, inspected, and penalized — DOLI publishes a penalty fact sheet specifically for state and local government employers. That's good news for the municipal utility electrician and the school-division maintenance tech, but it means public-sector EHS programs face the same citation exposure as private plants, usually with thinner staffing. A written, 70E-based electrical safety program is how a Virginia public entity gets ahead of the inspection instead of reacting to it.

06How the 2027 edition lands in Virginia
Every change in the 2027 Implementation Guide applies here, but four hit Virginia employers with particular force:
- The additional-person requirement multiplies across Data Center Alley's lean critical-facilities teams, one-electrician night shifts in Valley plants, and remote Southside solar sites. Staffing plans, not just permits, have to change — and in the data center world, that math belongs in the service contracts.
- Host/contract employer coordination — Northern Virginia's data center economy and the Hampton Roads maritime sector both run on layered contractors. The 2027 edition tightens the two-way documentation duty of 110.5. If you can't produce the hazard information exchange in writing, you don't have one.
- The new solar article (380) — Virginia's utility-scale solar and storage buildout puts a growing share of its electrical workforce under PV-specific requirements, mostly at remote sites where the additional-person rule bites simultaneously.

07Virginia employer compliance checklist
- Map every site to its jurisdiction — VOSH, federal OSHA maritime, federal enclave, or MSHA — and make sure your program and your people know which rule set applies where
- Build the Overhead High Voltage Line Safety Act into pre-job planning: survey overhead lines on every site, and make utility notification before ten-foot work a hard gate, not a suggestion
- Put your written Electrical Safety Program against the 2027 edition — or if you don't have one, build one now
- Separate "DPOR licensed" from "70E qualified" in your training matrix — verify every worker who interacts with energized equipment has documented, task-specific qualification
- Extend awareness-level training to non-electrical workers — roofers, tree crews, scaffold erectors, grounds staff, and anyone raising ladders or equipment near overhead lines; every fatality on this page was in that population
- Deliver training in the language your crews actually speak — in Northern Virginia's construction workforce that means Spanish-language capability is a program requirement, not an accommodation
- Audit host/contract employer documentation at every site where contractors touch electrical equipment — two-way, in writing, especially in data center and shipyard environments
- Model the additional-person requirement against your actual shift rosters, remote sites, and critical-facility maintenance windows before the 2027 adoption date
- Public entities: you are covered and inspectable — fund the program like the private sector has to
