NFPA 70E Compliance in Wisconsin

01Who enforces electrical safety in Wisconsin

Wisconsin is a federal OSHA state for the private sector — there is no Wisconsin state OSHA plan. Private-sector workplace electrical safety is enforced directly by federal OSHA through its area offices, applying 29 CFR 1910 Subpart S (1910.331–.335), 1910.137 (electrical protective equipment), 1910.147 (lockout/tagout), 1910.269 (electric power generation, transmission, and distribution), and 1926 Subpart K for construction — with NFPA 70E as the recognized method of compliance for safe work practices.

Federal OSHA operates four area offices in Wisconsin — Appleton, Eau Claire, Madison, and Milwaukee — all under Region 5 (Chicago). The Appleton office sitting in the middle of the Fox Valley paper corridor tells you where a lot of the state's inspection activity historically comes from: heavy manufacturing, converting plants, and food processing.

Where Wisconsin differs from most federal-OSHA states is the public sector. Employees of Wisconsin cities, counties, school districts, and state agencies are not covered by federal OSHA — but they are not left in a regulatory vacuum either. The Department of Safety and Professional Services (DSPS), through its Division of Industry Services, establishes and enforces occupational safety and health standards for public-sector employees, adopting standards equivalent to federal OSHA's, handling complaints and inspections, and requiring public employers to report fatalities and submit annual injury summaries. Three practical consequences for Wisconsin employers:

  • "70E isn't law" doesn't protect you. OSHA cites the electrical work practice standards in Subpart S and uses NFPA 70E as evidence of what a reasonable employer would have done — both for specific standards and under the General Duty Clause. Every case in Section 3 below follows that script: the citation is written against 1910 or 1926, but the gap it describes is a 70E gap.
  • Public entities answer to DSPS, not OSHA — but the standards are the same. A village electric utility, a school district maintenance shop, or a county highway garage in Wisconsin faces OSHA-equivalent electrical safety requirements enforced at the state level. That's real coverage — but DSPS's public-sector program is small, largely complaint-driven, and doesn't carry federal-scale penalty pressure. In practice, your written 70E-based program still does most of the protective work.
  • Repeat violations follow multi-site employers. Wisconsin's economy runs on companies with many locations — dairy plants, converting plants, utilities, grocery/convenience distribution. A citation at one facility can become a "repeat" with multiplied penalties at another. One weak site program prices the whole company.

Wisconsin's fatality profile is unusual: agriculture — not construction — is the state's deadliest industry, a direct reflection of the dairy economy. Construction recorded 16 Wisconsin deaths in 2024 and manufacturing 6. Nationally, the utility industry (0.75 deaths per 100,000 workers) and construction (0.73) have electrical fatality rates roughly seven times the all-occupation rate of 0.11 — and electricians as an occupation sit at 2.89 per 100,000, twenty-six times the average worker's risk (ESFI analysis of BLS data, 2011–2024).

Two more national findings that should shape a Wisconsin program:

  • 70% of workplace electrical fatalities happen to non-electrical workers — farmhands, maintenance generalists, machine operators, tree crews, equipment operators. Three of the five Wisconsin cases below involve exactly this population. If your 70E training only reaches licensed electricians, it's missing most of the people who die from electricity in this state.
  • Hispanic and Latino workers carry a disproportionate share of electrical fatalities (0.18 per 100,000 vs. 0.10 for white non-Hispanic workers, per ESFI). Wisconsin's dairy farm and food processing workforce includes a large Spanish-speaking population. If your training isn't delivered effectively in Spanish, it isn't delivered.

03Real Wisconsin cases: what the citations say

Abstract risk doesn't change behavior — cases do. These are real, recent Wisconsin incidents, drawn from OSHA's accident investigation and enforcement records. Each one maps to a specific NFPA 70E requirement that, followed, would likely have changed the outcome. I use cases like these in class because every one of them started as an ordinary work order on an ordinary day.

Waukesha December 2024 Fatality $63,250 in initial OSHA penalties

Test technician killed by arc flash on a high-voltage transformer — Prolec-GE Waukesha

A 34-year-old test technician at transformer manufacturer Prolec-GE Waukesha was working alone, elevated about 15 feet on a scissor lift, disconnecting power leads from a high-voltage transformer under test. The circuit had not been effectively de-energized or verified as de-energized. As he loosened a nut on a power lead, an arc flash occurred at roughly 8,000 volts, throwing him onto the transformer with fatal burn and shock injuries. OSHA cited the company under 1910.333(b) (verification of de-energization) and 1910.305, with initial penalties of $63,250, settled at $36,650.

this is Article 120 in its purest form — the eight-step verification of an electrically safe work condition in 120.6 exists precisely because "the circuit should be dead" and "the circuit is dead" are different facts, provable only with a test instrument (Article 110.6). And note the staffing: a technician alone, at height, on an 8 kV circuit. The 2027 edition's additional-person requirement is aimed directly at this scenario — in the state that builds the transformers, a test floor is exactly where it lands first.

Cudahy (Milwaukee) March 2023 Fatality $118,304 in initial OSHA penalties

Maintenance worker electrocuted wiring a light fixture on an energized 277V circuit — Ewald Automotive Group

A maintenance employee at a Cudahy car dealership was installing a replacement high-bay LED fixture from a scissor lift, direct-wiring the fixture on an energized circuit, when he contacted 277-volt three-phase conductors and was electrocuted. OSHA issued seven serious violations — including multiple lockout/tagout failures under 1910.147 and electrical safe work practice violations — with initial penalties of $118,304, reduced to $87,947.

a lighting circuit is exactly the kind of task employers wave through as "minor" — and 277V lighting kills maintenance workers year after year. Article 110.2 requires an electrically safe work condition unless energized work is justified under 130.2, and justification for live-wiring a light fixture essentially doesn't exist. The deeper failure is scope: this was a maintenance generalist at an auto dealership, not an electrician — the 70% problem from Section 2, standing on a scissor lift. Ask who at your facility changes ballasts and fixtures, and whether they've had one hour of shock-hazard training.

Sheboygan January 2021 Fatality + hospitalization Utility — backfeed

Lineman killed by generator backfeed during underground line repair — Alliant Energy

Contractors excavating a water line in Sheboygan struck an underground power line. While two Alliant Energy line workers repaired the damage, a neighboring facility's standby generator started, and an employee there manually switched it to feed the warehouse — sending electricity backfed through an ungrounded transformer into the section where the crew was working. A 26-year-old line worker was electrocuted and killed; a 58-year-old coworker was hospitalized with severe hand burns. OSHA cited a serious violation of 1910.269(c) — the job briefing rule — with a $13,653 penalty.

de-energizing the known source is step one, not the whole job. Article 120's process exists to find the sources you didn't know about — customer generators, solar inverters, double-ended feeds — and 120.6 ends with testing every conductor and grounding where reinduction or backfeed is credible. Utility T&D work runs under 1910.269 rather than 70E's core scope, but every dual-role municipal utility and every contractor who touches both sides of the service point needs the program to say which rule set governs which task. Prairie du Chien area August 2023 Fatality Rural electric cooperative

Co-op lineman electrocuted splicing a downed line that became energized at 7,200 volts — Scenic Rivers Energy Cooperative

A 45-year-old power-line worker for Scenic Rivers Energy Cooperative — the rural co-op serving southwest Wisconsin's driftless dairy country — was preparing to splice a downed power line one evening when the line became energized at 7,200 volts. He contacted the conductor and was killed. OSHA cited two serious violations of 1910.269, including the minimum approach distance requirement, with initial penalties of $19,005, settled at $14,254.

a downed conductor is energized until it is tested and grounded — full stop. The premises-side analog is 120.6's verification and temporary grounding steps: storm restoration, evening call-outs, and small rural crews are precisely the conditions where "it's been dead for hours" gets someone killed. Wisconsin's co-ops run lean crews across enormous farm territories; the discipline that protects them is procedural, not supervisory, because the supervisor is forty miles away.

South-central Wisconsin March 2022 Fatality Tree care

Ground worker electrocuted when a lowered tree section broke a 69 kV line — Tree Wise Men LLC

A tree crew was lowering cut sections more than 30 feet long with a truck-mounted articulating crane. A section being lowered struck an overhead line energized at 69,000 volts; the conductor broke and fell near the 38-year-old ground worker collecting sections, electrocuting him. OSHA's investigation noted the crane's roughly 55-foot vertical reach exceeded the clearance to the conductor, which ran 48 feet above ground — the geometry made contact possible before the first cut was made.

Article 130.9's overhead line rules and the approach boundaries for unqualified persons — but the controlling failure was planning: reach-versus-clearance is a number you can compute in the parking lot, before anyone starts a saw. Overhead contact is 49% of all U.S. electrical fatalities, and the victims are overwhelmingly non-electricians. If tree contractors, sign crews, or boom trucks work at your Wisconsin facility, verifying their line-clearance planning is part of your host-employer duty under Article 110.5.

The pattern across all five: not one of these was an exotic failure. A transformer test nobody verified dead. A light fixture wired hot. A backfeed nobody planned for. A downed line nobody grounded. A crane with more reach than clearance. The 2027 edition's changes — the additional-person requirement, tightened host/contractor duties, job safety planning — are aimed at exactly these ordinary moments.

04DSPS licensing and what it requires

Wisconsin licenses electricians at the state level through the Department of Safety and Professional Services (DSPS) — the same agency that runs the public-sector safety program and the state electrical code. Credentials include registered electrician, electrical apprentice, journeyman electrician, industrial journeyman, residential journeyman, master electrician (plus registered and residential master classifications), and electrical contractor. A journeyman performs electrical wiring under the general supervision of a master electrician. Two facts matter for your electrical safety program:

The licensing gap is the single most misunderstood point I encounter in Wisconsin classes. A DSPS license certifies competence in installation per the adopted code. OSHA's "qualified person" concept — and 70E's — requires demonstrated training on the hazards of the specific tasks and equipment: shock hazards, arc flash hazards, boundaries, PPE, and the skills to distinguish live parts and verify de-energization. A master electrician's license does not make someone a qualified person under 70E, and OSHA has cited employers who assumed it did. The Prolec-GE case above involved a test technician — highly skilled, and dead precisely at the seam between product knowledge and safe work practice.

05Industry by industry: where 70E does the work in Wisconsin

Paper and converting (Fox Valley, Wisconsin Rapids, Green Bay)

The Fox River corridor from Green Bay through Appleton to Neenah holds one of the densest concentrations of paper and converting capacity in North America. Electrically these are old, big, continuously running plants: legacy MCCs and medium-voltage distribution dating back decades, drive systems on machines the length of a football field, and maintenance windows measured in hours because a paper machine restart is expensive. That combination — aging gear, production pressure, and "we've always done it live" culture — is where energized-work justification under 130.2 gets stretched past what it can bear. The fix is structural: an energized work permit process (130.3) with a signer who is allowed to say no, and incident energy data current enough to trust (arc flash studies on gear this old are frequently stale). Machinery, heavy manufacturing, and shipbuilding (Milwaukee, Oshkosh, Racine, Marinette)

Wisconsin builds heavy things: mining equipment in South Milwaukee, motorcycles in Milwaukee, defense trucks at Oshkosh, agricultural and construction equipment in the Racine area — and Navy frigates at the Fincantieri yard in Marinette, plus Great Lakes ships at Sturgeon Bay. Manufacturing and shipbuilding share a hazard profile: test-and-commissioning work on energized equipment (the Prolec-GE arc flash above is the archetype), dense contractor populations inside host facilities, and — in the yards — temporary shipboard power, wet environments, and confined spaces that multiply shock consequences. Host/contract employer coordination under Article 110.5 carries enormous weight in these facilities, and the 2027 edition tightens the documentation duty on both sides. Food processing: dairy plants, breweries, and distribution (statewide)

Cheese and dairy plants operate in nearly every Wisconsin county, alongside breweries from Milwaukee to New Glarus and giant grocery/convenience distribution operations. Electrically, food processing means washdown environments — water, corrosion, and NEMA-rated enclosures that stop being watertight the third time someone re-lands a cable — plus ammonia refrigeration systems whose compressor rooms concentrate large motor loads, and sanitation crews working nights around equipment that maintenance "de-energized" at the panel without locks. LOTO-to-70E integration is the whole game here: Article 120's process, applied by second- and third-shift crews who are least likely to have been trained. Data centers (Mount Pleasant and the I-94 corridor)

Microsoft is building one of the largest data center campuses in the country at Mount Pleasant, on the site originally graded for the Foxconn project, and utility planning along the Milwaukee–Chicago corridor assumes more to come. That means two distinct 70E populations: thousands of construction and commissioning workers around progressively energized switchgear as buildings phase into service (the 1926-to-1910 handoff), and lean critical-facilities teams doing inspection, testing, and maintenance on UPS and distribution gear under uptime pressure — the exact task profile that killed the technician in the Waukesha case. Power generation in transition (We Energies, Alliant, WPS)

Wisconsin's utilities are mid-transition: coal units retiring or converting to natural gas at sites like Oak Creek and Edgewater, new gas peakers and utility-scale solar and battery projects coming online across the southern half of the state. Transitions are electrically dangerous in a specific way — demolition and decommissioning crews working around equipment whose energization status changes week to week, plus commissioning of new gas, solar, and storage assets, often with contractor crews unfamiliar with the site's legacy one-lines. The Sheboygan backfeed fatality shows how sources nobody briefed become fatal; multiply that by a substation rebuild. Utility-side work runs under 1910.269, but every plant balance-of-plant task, every contractor, and every storage container falls back into 70E territory — including Article 360's battery requirements. Dairy farms and stray voltage (the most Wisconsin electrical topic there is)

Wisconsin is the only state where "stray voltage" is a household term — decades of litigation between dairy farmers and utilities over neutral-to-earth voltage affecting herds made it famous, and the Public Service Commission runs a dedicated stray voltage program. For the safety professional, the farm electrical story is grimmer than the litigation: agriculture is Wisconsin's deadliest industry (30 deaths in 2024), farms are full of aging wiring, portable generators, grain-handling equipment near overhead lines, and workers with zero electrical training — and family farms largely sit outside OSHA enforcement (the small-farm appropriations exemption). No inspector is coming; awareness training, generator transfer-switch discipline (the same backfeed physics that killed the Sheboygan lineman), and overhead-line clearance planning for silage equipment are the whole program. Co-ops and farm suppliers who send workers onto farms should treat Article 110.5 host/contractor duties as flowing in both directions.

Public sector (cities, counties, school districts, state agencies)

Unlike Texas or Florida, Wisconsin's public employees have enforceable coverage: DSPS's public-sector safety program applies OSHA-equivalent standards to every municipal electric utility, wastewater plant, school district, and county shop in the state. That's the good news. The realistic news is that a small state program cannot inspect its way to safety across thousands of public employers — which means a written, 70E-based electrical safety program is still the operative layer of protection for the village lineworker and the school maintenance electrician. If you administer safety for a Wisconsin public entity, DSPS coverage is your floor, not your program.
